You are right it is getting too much for me. I am crying just writing this. I am not sleeping and getting pains in my chest with the stress.
Is there a debt advise agency that I can talk to about options including bankruptcy?0 -
Get those CSA calculations checked, with your high outgoings, maybe they should be lower.
I wonder if you have been prioritising your debt payments correctly? Your mortgage should be the absolute highest priority.
You should really get an offer on your house and then go back to court and tell them that after X months on the market, the only offer you have had is Y and ask the courts permission for it to be accepted.
The other option would be to find a place to rent and then hand the keys back to the lender ie voluntary possession. Once that is done you can consider whether you can manage your debts or need to consider a debt management plan or even bankruptcy.
The priority is having somewhere secure to live, concentrate on that. I suspect you are wasting your time/money paying any more money to your creditors, just pay essential bills and put food on the table for your family, keep whatever cash you can to yourself.

Go on the debt free wannabe board, plenty of advice over there. You need the right agency as some end up keeping most of your payments as charges. Child maintenance rules have changed. He owed a few thousand in arrears, mainly due to CSA errors but they are now collecting arrears in two years so his arrears payments have gone up from £5 a week to £50 a week not negotiable.
Non negotiable? Their mistake? I'd drop the payment back to £5, then send them a statement of your ingoings and outgoings to show you can't afford £50 a week. That's £2600 a year!! Tell them at £50 a week, you'll lose your home and won't have anywhere for the kids to stay then.

Not since April 2006 when the laws changed. Prior to that, if a credit card company want to take your house, it involved a lot of court time, and even then they would struggle as they would have to prove you were avoiding paying.
Now they just print out a list of names, addresses and amounts, take it to the local magistrates court, fill in one form for the entire "batch" and get it rubber stamped by the clark of the court. And Bingo, they have your house!
This was introduced VERY QUIETLY in April 2006. In fact, it was so quiet is is in fact a massive scandal, but no-one has covered.Bankruptcy isn't the worst that can happen to you. The worst that can happen is your forced to live the rest of your life in abject poverty trying to repay the debts.0 -
