The other buying abroad thread has had an interesting development today.

    good luck to all

I couldnt find anything new other than your post on the other buying abroad thread.

I am certainly keen to hear of any development that could even vaguely affect me.

    Thanks.
  • Hi Avicola. Have you had anyone at all check out the contract? I speak Spanish and am quite prepared to try and help. Don't mind calling the agents/developers as your angry advisor and to see if I can put some pressure on them to give you an exit strategy.

PM me if I can help.

thanking you from the heart of my .....
had given up on the sense of some of the posters, been having a bit of a spat over on the "grilling of my family" thread, which incidentely started off as "I want to kill myself and my family". The poster thought he was being funny.
Not that I wish bad on anyone, but there are some people on here that really do need help.

Hope you can shed some light on this situation.

Have you considered trying them at auction - might work, mig ht not, depends if you can pass the hot potatoes on or not?

Then again some people might want a 2nd property anyway?

First of all, thanks to everyone.

tomorrow we go to see a spanish solicitor who is fully conversant in spanish property law.
the main aim of that is to see if we can get out of the contract.

the reasons for that are that we have signed something which we do not understand which is potentially not legally binding. the second reason is that they have over-run the completion dates.

I do speak spanish, but it would appear not well enough to understand certain points. Having said that, I have never 'professed to speak spanish' well enough to.

I am also speaking with the solicitors who the estate agents have recommended to me with a view to getting the contract annulled. just trying to make sure i get the true picture now.

it is still a long straw though.

another idea is to see if the developers will allow us some leaway and 'do a deal with us.' that might, for example, mean us taking possession of say two apartments if they can let us keep our deposit on those two, plus let us keep the deposits on two others without taking posession on them.
then we could take a mortgage out and let them, using the rent money to help with the mortgage.
The developers would still get to keep the deposits from the remaining 3, and at least have 2 sold.

after that, we have to look at action against the estate agent who we feel have been potentially negligent in their dealings with.

they actually told us we didnt need legal advice as there was no chance they would not be sold before completion. which was true as it stood at the time.
what we should have been told is that it was imperitive we took out legal advice,
additonally, we should have taken out insurance against this happening and
thirdly, they should have made sure they had a disclaimer.

I know we are to blame at the end of it, so honestly i know that.

have definitely considered auction. It is a bit late now they have dropped this sudden completion date on us with 4 weeks notice, but certainly if we can get an extension to the completion date, that is an option and it is being looked into at the moment.

thanks for the thought. it is a valuable one.

Thanks so much for that. Maybe in the future .....

if you have a look at the posts a couple previous to this one, i have given a sort of update on what is happening.
The estate agents are English with some spanish bi-lingual, so communication with them is no problem.

    But you never know.

That is so kind of you though.

    Thanks for the update.

It's good you've got a solid plan and path and some options again.

    Good luck with that!
