  • the op said she was using a provisional licience, this is not a full licience yet, so what is she banned from? Taking her test? Lessons?
    More than likely the fine will scupper any lessons n the immediate future, so does it 'ban' her from driving when she legally can.

    i was under the impression that she'd be banned for 18mths on her provisional and wont be able to get behind a wheel again even to have a lesson until the ban is up :confused:

    Well if she's banned from driving, I'm guessing she cant even take lessons, do you not have to produce a provisional licence to get lessons, so if someone has their licence revoked that would include provisional.

  • My point is how can she lose her licience when she hasn't got 1.

    I'll leave it at that, stiffer sentances such as a 5 year ban if no licience, 10 years if you have 1.

    Its a moron who drinks and drives and it should carry a larger penalty.

    fines from courts are more or less relavent to your status.

    If your friend is unemployed fining her £5000 would be pointless as it would never get paid off.

    I reckon she will be fined £500 to £700 and be given time to pay it.

    Not sure how it works, but I knew someone who got speeding points on a foreign drivers licence. She had to pay the fine etc, and when she got her UK licence (some sort of exchange thing) the points were automatically added to her UK licence.

    So the crunch is, the points / ban will be there (prob in DVLA records) until such time as she can re-apply for them.

    Good luck with the insurance premiums - they will be hefty !

    well as you'll understand i have no sympathy but what i would say is if they have a car sell it, because she wont be driving it for a long time

    i mean how silly can you be if you are a learner -
    1 not being with qualified person while learning
    2 drink driving
    3 drink driving and having provisional
    4 invalidatin insurance through drink driving
    5 invalidating provisonla with dirnk driving
    6 driving on wrong side of road

    in my opinion people like that should be locked up - i know its harsh but how would you feel if they crashed in to you personnally. well i think ban should be at least 2 years and a large fine - if you do the crime pay the fine

    i mean i had my liscense taken off me for 9 months all because i had a seizure when in hospital because of a one off allergic reaction
    where is the fairness??????????

    i agree with everyone, she should count herself lucky that she didn't kill someone.
    she should accept her punishment like the adult she is meant to be and stop thinking about herself.

    There are two sides to every story and it was an abosolutely stupid thing to do BUT she should consider how very, very lucky she was.

    Look at the footballer who was twice over the limit last saturday.

    He killed two children, left their father with a broken back, neck and internal injuries and has destroyed a family.

    She will suffer the consequences and will have learnt a tough lesson.

    Totaly agree with all the comments it was her own stupidity but I would warn anybody not to sleep it off in the car. Many years ago my OH went to the pub as usual with the car ( he always gets a taxi back) On this particular evening he had a lot to drink as some friends arrived and forgot to book a taxi (we live in a rural area) by the time he remembered it was too late to get one but he managed to get one booked for 8am. As there were no taxi's or buses and a 10 mile walk ahead in winter he left the keys with the landlord and slept in the back of his car in a sleeping bag. The police knocked on the window at 3am he was charged with drink driving. Even with all the evidence in his favour he still lost his licence for 6 months and this was by doing the right thing. So I think she should take whatever is coming to her as she made no provision at all.
