They are purposefully misleading and some are designed to reject upto 90% of all claiments irrespective of merit.
I got stung by JUST3G.co.uk. I lost my cashback on a irrelevent technicality that they claim voided my offer. I really dont understand it, but in a nutshell they claimed that I should have sent them 7 bills to show 6 months of good standing with three. They dont answer emails and their 0870 number charges about 10p a min to keep you holding before being cut off.
I have since been talking to people in the trade and they have told me the following to be so:
- Online retailors depend on rejecting a vast amount of their claims because they have no local presence and it easy to ignore emails and phone calls.
- THREE network is unique in NOT clawing back commissions if the dealer has followed procedures. In other words, one could default after a few months and the dealer would not lose anything. The whole cash back process is designed to be complicated so as to fustrate users. There isnt any real way of defrauding the dealer.
- Cash Backs are good but only use a business with a local physical presence. Here you can go in and have your claim processed in person. My contact who runs a physical business says, that his rejection rate for cash back is less then 3%, ie. 97% of all his customers get their money. The opposite seems to be true for online retailors. My contact tells me that he personally knows of online business that will never pay out a cashback no matter the validity of the claim.
In a nutshell, DONT do online tariffs that involve cashback. Only go for cash back where you can physically see the shop and drop in their claim.

Surely CPW online aren't going to stitch us up for there cashback?0 -
Unfortunately Just3G have a reputation for being complete cowboys - they are notorious for refusing to honour cashbacks. The usual way to collect your cashback from them is with a County Court Judgment.
See: http://www.agreements.plus.com/web/just3g/ and various mobile phone forum posts from dozens of Just3G customers cheated out of their cashbacks.bargainaholic wrote:I have just been through the exact same saga with a bunch of m*r*ns called Just3G. Their website T&C still says send "copies" of your bills.
Luckily, I have legal insurance as part of my home contents cover. They took the case on for me, & after the legal team made it quite clear they were taking them to small claims court, they agreed to pay the money as a "goodwill gesture", though still insist I'm in the wrong, & their T&Cs aren't ambiguous at all.
I'm still waiting for my money of course - cheque was alledgedly sent on the 28th August
Best of luck, & do keep with it. I'm sure this is all deliberate smoke & mirrors to stop people from claiming what is due to them, & we need to show these companies that they must trade fairly.0 -

DHow did you get on with this?0 -
What was the outcome of the cases referred to in this thread please? Did Themobileoutlet and Just3G pay up? With or without court action?
Many thanks

Mobile Outlet seem to be relatively unheard of on these forums, but having had personal bad experiences with them I have to urge everyone to try to steer clear of mobile outlet and possible mobile rainbow (who i have a fishy feeling is part of the same company). They are very unprofessional in their mannerisms and this alone should raise suspicions. Add this to the fact that they try to confuse the hell out of their customers and provide relatively NO support should pretty much cross them out of any logical thinking person's list of trusted companies. Please all steer clear. Sori to hear that u have struggled with them Mcbain, I wish i could have told you this sooner.0

Hi I have the same problem as above, I interpreted the term and conditions to mean send your 11 and 12th month bill together within 28 days of getting the 12th bill. I did this and this morning received my bills back and a letter saying I did not send my 11th bill to them within 28 days. I went on the website to check the terms and conditions and they look like they have now changed.
Shall be hunting around for my copy of T AND C'S that was sent in the post.0 -
Mcbain wrote:Ha! an interesting turn of events... the problem with the bill applies to myself and my girlfriend... i've been trying to find out if anyone had similar problems.. My friend who showed me this deal moved away and i've not spoken to him for ages, but i've just emailed him.. and guess how he interpretted the T&Cs.. yes that's right, same as my girlfriend and I.
He gave up on his claim but i've told him to stick at it as the more people we have with this problem, the more chance we have of winning at small claims court..
Cheers for the advice folks.. next thing is advice about small claims court... but i'll leave that for a while and see where a threatening letter gets me.
Hi
I also read the Mobile Outlet terms and conditions as everyone else seems to have. I am a solicitor and think they are misleading and contravene the Unfair Contract terms act. I am going to take them to the Small claims court but it would help my case to add in a few other people who also understood it as I did and it would also get you your money back too if we win.
If you are interested in suing them with me, please email me back. We might have a better chance if there are several of us and it will only cost about £20 each depending on how many people email back. Obviously, I won't charge legal fees as I will be doing this in my private capacity rather than as a lawyer. Nothing to lose really except £20 if we lose....

Hi
We have been having problems with the mobile outlet. We sent our 1-6 bills back within the stated time. However they have refused to pay our cash back as they say we should have sent a dispatch note. However the terms and conditions when we took the contract out did not say this.
On the 3rd July they changed thier terms and conditions (this is after we took our contract out with them). In these terms and conditions they state to send the dsipatch note.
They will not talk to you over the phone regarding any cash back issues. They have been slow responding. Completley unhelpful.
We are trying to speak to CAB and Trading Standards. Not sure if we will ever get the money back even though we are in the right.
I would never purchase anything thing else from this company and defiantely would not recommend them.0
