    I've been Money Tipped!
Ypu might be grateul if it ever does dry up for the extra water!

I'd go round with a cake/bottle of wine and say that you don't want to fall out over it, you don't want to be a misery guts, etc etc, but explaint the problem. :) What happens and how it plays on from there is his choice really.

The OP was asking for advice on what they should do.

Please note that my first advice was to 'ask him nicely to fix the problems', which would seem obvious as they may be unaware of the problem their pool is causing.

The second bit of advice was to clarify their legal position if the neighbour was unwilling to rectify the problem. Thereby giving a complete answer to the problem posted.

All my advice was legally correct.:A

You could start the conversation with "I think that your pool might have a leak." Then show him all the water in your garden!
  • yes, i'd ask him to come see your side of the fence. he prolly dosent realise whats happened

The pool would appear to have a leak? Perhaps neighbour is not aware? Maybe he is and that is why he moved it to the edge of his garden.

I would try the friendly neighbour approach, but I would not be fobbed off. If negotiation fails, the water board might not like him wasting water.

What vomityspice (urgh) was alluding to was an action for private nuisance - for a simple summary see http://www.a-level-law.com/tort/nuisance/lecture.htm. However, it is not usually a good idea to go into this kind of situation planning to bring legal action, it's not conducive to good neighbour relationships, quite apart from the cost, risk and stress! But, it might help you in any friendly discussion to know that the law is likely to be on your side (the water is effectively escaping from his control and disturbing your enjoyment of your land). And if a friendly discussion doesn't work, perhaps a letter from a solicitor ...

    Hi there,

I would be worried that, if the ground is saturated already with this water, one heavy downpour of rain and you could be in flash flood land.

Ask him to sort it out asap
