Neighbours waterlogging our garden...

Short version of the story. Just wanted some advice, or if I'm being overly sensitive about it! (as hubby thinks sometimes!).

Neighbours backing onto our back garden have got one of these big pools for their 3 kids to play in during the summer. It's one with the wood round the sides, looks like the 'permanent' kind but can be dismantled and is really big! Trouble is this year he's put it way to close to the fence, away from his house and sight, and the water is just coming through the fence and waterlogging the area, and I mean waterlogging. The water is a good 1-2 inches (it's in a bit of a dip where the flowerbeds used to be) and as our garden slopes the water is then draining towards the house as it can't soak in to the ground.

It's making our garden unusable sometimes as it's so wet, even if it hasn't rained for days, specially after the kids have been in the pool for a good hour or so. At the weekends, if weather is good they tend to be in there pretty much nonstop.

It's ruining the end of the garden as it's practically marsh land now! Going to hang the washing has to be done in wellies as the grass is so wet and squelchy!

I know it might be a minor thing but it's kinda getting me down, specially as we have another 2/3 months with it happening. The flower bed we planned is on hold as it would just get overwatered and ruin it.

Any advice? Should we say something? He obviously can't move the pool now but not sure what to do. They are nice enough people but not sure of the answer at this stage. I know it's his garden to put a pool where he wants to but the consequences for us are not funny. Would digging kickboards in help?(as the bottom of the fence is just laying along the ground right now).

  • I would say something. I know it can be difficult, but he probably is totally unaware of how it is affecting you and your enjoyment of your garden. Why not get your OH to invite him around for a bee/wine/cuppa and show him what's happening.

    Yep, as per Al Mac's reply.

    He's probably not even aware that it's leaking into your garden so go round and tell him that you've got a river running down your garden and want to know !!!!!! is causing it. If he's owt about him he'll sort it there and then.

    Should be simple enough to sort out I would've thought.

    We'll make a move this weekend to mention it and see what he says.

    You can ask him nicely to fix the problems and if he won't, sue him for your damages! (This might not get you 'best neigbour of the year award'!). He wouldn't need to move the pool if it didn't leak?!

    The case you need to quote is Rylands v Fletcher (Google it!). Simply, if somebody brings something onto their land which then impacts/effects your, you have a case of Tort (Civil wrong) for negligence.
