non payer dispute & Ive had a refund.. what happens now?

I opened a dispute with paypal for an item not received and got a refund - the seller didnt answer any of my messages when I asked when the item had been sent as it hadn't arrived yet.
Now he's opened a non paying bidder dispute on me and I have an alert on my account.
I wasn't sure how to respond to this so I put in the facts and said that I no longer trusted the seller and wished not to do any further business with him.
Will I get a strike? seems highly unfair if I will.

You need to forward the message to Ebay as they don't have anyone reading the messages (the only one who does is the seller). He can give you a strike but it will be removed if you do that. Make sure you neg him, he can't neg you back and a neg will restrict his account more than a strike will affect yours!.0

Ok a bit more news on this..
Firstly, thanks for all responses which have been most helpful.
Seller responded to my message on the dispute console and said sorry I didnt get my item and telling me I should mutually agree not to continue with the transaction - I presume so he could get his listing fees back.
However - I pointed out that I didn't mutually agree , but that my item hadn't arrived and I had to claim back my money after he didn't respond to my messages asking where was the item I'd paid for, and that it wasn't the same thing as mutually agreeing and that I was sorry too.:D
So now the dispute is closed - I've got no strike and he gets no listing fee back - I'm happy.
Apparently... he's not. I get a message not even 10 minutes after the dispute is closed - it's a pity he wasn't that fast in responding to my message asking where my missing item was!
Now he's telling me that it appears I want to continue with the transaction -don't know what would give that impression especially as I said in the dispute communication that I no longer trust the seller and don't want to do any further business. :cool:
He's asking me now to pay by postal order or cheque to avoid another NPB :rolleyes:
He can't open another NPB can he? and anyway why would I send him a cheque or postal order so he can get his hands on my cash and not send the item again - He's having a laugh surely :mad: :rotfl:0 -

Ignore him.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -

Yep, and it's people like you who make it hard on all the other buyers.
I go straight for UPI and skip the mutual, even if I don't want to give the buyer a strike. So for every buyer who's had a strike, I'm sorry but it just isn't worth the risk anymore of losing your fees refund.
Whatever your thoughts, if the sale doesn't complete, ebay should not get to keep the FVF, they've got their listing fees, the FVF is paid out of the profit.0 -
It's hardly the OP's fault. They paid and were given the runaround, with no explanation.
Do you think OP should have kept quiet and accepted the strike, just so the poor widdle seller could get the fees back for the item which he had inexplicably decided not to bother posting?
Oh, and ebay will be meting out punishment to sellers who open false UPIs.My TV is broken!

It has to be weeks...a buyer can't open an item not received claim until at least 7 days after payment. The quickest paypal ever deal with it is 10-21 days assuming seller does not respond.
