work has overpaid me and i have spent it what should i do

    I am going to tell you something I know as FACT and I DO KNOW IT unlike certian members claiming to when they have no ideal.
    I will give you an example here:

    If you found £50 on the floor AND - Note the AND, and saw who dropped it and knew where they lived etc and could give it back to them however went and spent it that would be THEFT!!!
    And is an offence, dont try saying thats a different story it is the same issues just different

    I worked for a few years on minimum wage. I only got a pay rise when minimum wage increased. If I had been overpaid by even £3 let alone £3000 I would have queried it with my employer as soon as the mistake was noticed, not kept it like you assume all poorly paid people would need/want to.


    I'm sure the OP, and indeed anyone who has ever tried to keep quiet about an overpayment would soon be shouting from the roof tops if their wages were short £3000.
    That would still be a mistake by the employer but I'm sure the employee would want that mistake sorting out immediately.

    By the sounds of it you knew it was not due, and eventually you will probably have to pay it back, maybe its a case of hard times require desperate measures?

    As for all the scaremongering regarding fraud, as long as you were expecting money coming in (tax refund - you can go back upto 6 years I believe) and use the money in good faith believing it was the money you were expecting, then the onus is on them to prove otherwise which would come down to your word against theirs so cant see how they could prove it one way or another, also the way you spent the money could justify that you genuinely expected the income to pay off debts, you could have gone out and spent it on luxuries.

    Hope it sorts it self out, if it was me I would have transfered the money in to a high interest account and waited for them to ask for it back.

    They have every right to claim the money back despite it being their mistake.I share some of the views above and would ask why would you even think about spending 3 k before finding out for definate why you were paid it?

    A harsh lesson I think.
  • Part of my role is payroll checks and there are so many different ways the error could happen so when and how they find out could vary

    At my work it could be immediate as part of a salary check, within days when the accounts are imported and the figures vary, at month end when the management accounts are reviewed, when the bank transfer doesnt cover the salaries when they should, at year end when budgets dont match, quaterly when outturns are done

    I certainly wouldnt hold my breath on them not noticing and when they do you are going to be in the deep

    NO ITS DIFFERENT, theres no such thing as your monthly pay can be called an usolicited gift. I dont think theres a precedent set in law you see.
    Heres a story for you a friend of my Mums who works for the council got paid what for it, wait for it, £250000.00 for a months cleaning, she was honest and had to give it back.

    Should we set up some TV deliveries?;)
