Landlords responsibility - re: nuisance tenants

    Yes, other areas have been chosen for selective licensing..the ones I know about are in Manchester, and these are Harpurhey, Openshawe, Beswick, Gorton and some streets in Moston.

    Having a quick trawl with the help of Google brings up other areas that are in the consultation stages, and these areas inhevitably are inner city areas of most of the bigger cities in the UK.

    Something else I found on the trawl was this from the RLA It's a year old, so I wonder if it holds true today.

    I hope this will bring the private LL's and the local authorities together a bit more and dispel the 'them and us' attitude, but at the moment, after talkng to LL's in the same area leads me to believe that most just see this as yet more unwanted interference, and there is a lot of resentment out there, particularly when you take into account the fee that has to be paid for each license.

    Personally, I am keeping a somewhat open mind...I have no choice...only time will tell I guess whether this will be a good thing. I hope so.

    its a tax - pure and simple - be under no illusion - if you want a tenant out - you do the work you pay the court fees - there is NO altrusim in local government

    Manchester has now nominated probably more than half of all its terraced housing Wards as "selectively licensed areas" - ie areas in which ALL rental properties have to be licensed

    The ONLY person - as mentioned here ages ago - who can evict the tenant is the LANDLORD - and the local authority is more likely to reduce council tax than it is to pay landlords legal fees to evict antisocial tenants on behalf of landlords !!!

    Get real folks !!!

    Selective licensing is a money spinner for the council - - end of - they get several hundred pounds per applicant for reading a few forms and sending some letters.

    Manchester is SOOOOO bluuddy inefficient they are already sending me threatening legal letters because they claim i am not registered (i was registered in August last year) - yet they dont reply to my emails or letters !!!

    and yes i do feel astonishingly ppppeeeed off by this legislation - it aint Landlords who wreck communities by wandering the street wrecking houses and cars and shops and stealing and and being YOBs - its usually tenants - so why not target tenants in these areas ?? BECAUSE THEY HAVE NO MONEY - Landlords are an easy target

    its like the Clawback on housing benefit - Bad tenants who were fraudulently claiming HB were not targeted to repay any overpaid HB amount - why ?- cos the councils know they have no money - so lets go claim off the landlords ....... soft options -

    one Council's HB form even says - if i get an overpayment clawed back from me by the local HB office and i dont pay it - they will take it out of the rent due to me from ANOTHER OF MY PROPERTIES - how legal does anyone think that is ?????

    i wish i could write Rant over - but i bet i come back to this in the future !!

    As long as my tenants pay on time every month it is their life so let them get on with it.

    Just a little story about HB and how the LL can fall foul of the tenants actions...mate of mine has a tenant on HB who it turned out was co-habiting without declaring it. Council found out and stopped her HB then went after my mate and forced him to pay back nearly £2000.

    To add insult to injury, the tenants boyfriend wrecked the wiring causing £4000's worth of damage, then they split up. All this time of course there was no rent coming in while they sorted her HB again.

    Income for that year on that property was less than what his 16 yr old earns part time waiting on tables in a resaurant at weekends. T

    Tenant is now on LHA... my mate figures that the risk of her not paying regularly is better than the risk of getting payments clawed back from him due to her actions.

    Our neighbour lives in a house her father owns. He is the landlord as he says they have an AST but their relationship is such I doubt if she pays him rent. Both properties share our boundary. Recently the landlord cut our boundary hedging and trees approx 3 ft back into our land effecting a trespass. We are taking court action as he has caused damage in the past with fencing and trees. He is now saying his daughter did the cutting without his knowledge. Can his daughter still be classed as his agent or servant as well as his tenant?

    You should start a new thread for this.

    Do you have witnesses who saw the actual landlord doing the cutting?
    I'm not cynical I'm realistic :p

    No we don't but the evening we discovered the damage his daughter told me it was him but would lie to the police if we got them involved and say that she did it in order to protect him from his actions. Also, the father is nimble and able, has all the equipment i.e. ladders, saw, long handled loppers etc. His daughter has no such equipment and is a rather stout lady who would have had great difficulty (if she did have the means to do it) climbing 12ft up ladders to remove a 6ft spur,let alone take 3ft off 7ft hedging.
