HMRC Visited my house today to distraint goods, HELP!!!

    Further update,

    Was tempted to bottle it and just sit it out til next week but managed to phone the tax office/recoveries dept.

    Spoke to an absolute megab1tch. She asked why was I ringing in, I replied to try and come to an arrangement with this debt, you already had one she replied and broke it:rotfl:

    I reminded her that I had actually paid them £500 in April (kicking myself now) and only missed May's installment due to only just starting a new career.

    And how do you propose to settle now?? I replied that I am looking at every option available, remortgaging, secured loans, and basically re assessing all my finances but I guarantee that i will settle once and for all in a fortnights time if they gave me breathing space. She agreed that no further visits would be made for 14 days, but if i didnt settle in full then they would proceed with further action:rolleyes:

    Oooh what delight I will have reading my BR number to her and giving her my ORs details:D

    At least i can sleep easy from now until BR.

    It's good to hear that you won't be bothered by them until after you have gone BR. Now to get down to the pesky form filling....only 35 pages to fill ;)

    No takers on a new thread so hopefully i'll get an answer here.......

    Just battling throught the online forms and have a question (I'm sure the first of many:rolleyes: )

    When it asks amount owing on mortgage do I put the amount thats showing on my credit file OR do i put the amount required to redeem mortgage??

    Also my early redemtion fee is£11841 (yes thats right nearly £12k:T ) until 2010.

    Is this taken into account before BI is established? In which case i should be laughing, bought for £245, balance owing £237781, (add another £1100 come the first of june) erc £11841.45, amount required to settle £249747.75.

    I am also putting property value as £240 as i think its reasonable to suggest a £5k drop in just over a year (maybe more) for a quick sale.

    Any help pls??

    stick the redemption fee in, they can chuck it out if it isnt applicable, at least they know...

    get plenty of valuations, im sure you know what you need.....

    Hi ITBS,

    At this point it's not really crucial what you put on the forms because they'll ask for valuations and proof of secured debt when it comes to calculating the B.I.

    Rather bizarrely, they don't take into account redemption fees and selling costs in the calculation of B.I but they will yield to some extent to reflect the costs they'd incur if they had to reposses the property and then sell it themselves.

    It's an unseemly, unfair process, and the more skilled a negotiator you are, the more likely you are to pay less for the B.I than a bankrupt in comparable circumstances without the "barter bug".:rolleyes::rolleyes:

    I get the feeling you know how to negotiate, and you'll need all your skills. That's why a few missed mortgage payments is no bad thing.:D:D

    I was quite !!!!!! off and down this morning but I must admit it's quite theraputic (in a macabre kinda way) putting all my debts down on the form knowing they are going to disappear:D

    Would love to see the look on the face of the megab1tch I got at the tax office today when I tell her Im ringing up as agreed to settle my debt............with bankruptcy:rotfl: :rotfl: :rotfl:

    I'm sure I should do alright with the house, i didn't realise the ER charges were so high so im sure i can get somel leverage out of them anyway.

    Do you know how long you actually have to buy the BI from the date of BR?

    Ah ITBS, I had exactly the same feeling with the pompous pr1ck that petitioned for our bankruptcy; we did everything we could to avoid bankruptcy, but when it was inevitable we just laid back and let it wash over us. Three weeks holiday that year helped,:cool::beer::D and what a relief to realise that none of the bugg3rz could touch us.

    There's no hurry with the B.I. We agreed the figure towards the end of our bankruptcy, and then did nothing about it for a while, and got a reminder almost six months later saying we'd need another valuation if we didn't complete by the end of the month; we completed.:D

    Another quick question.

    I went 2 months in arrears with Council Tax due to starting out the taxi. I rang them to pay in full but they refused saying the only way they could put me back on a payment plan was to repay by direct debit, and they would just reschedule the payments with these 2 missed ones in (plus £65 court costs:mad: )

    I know I'm chancing my arm but is it worth cancelling the DD and including the arrears in the BR, or is that risky with it being CT, there again, am I not being preferential to them by repaying arrears:confused:
