HMRC Visited my house today to distraint goods, HELP!!!

    Tis true Bat, but it brought out the devil in her too;:eek: :eek: most company car drivers didn't appreciate being beaten away from the lights by a "granny racer".:D :D:D

    At least i give it 110%.............

    I'd sooner pay the fees myself and still have some control over it rather than have HMRC turn up and frighten my OH or turn up when she has her friends round.

    Just feel so !!!!!! off, really thought I could graft my way out of this.:mad:

    To make matters worse just spoke to the court and the earliest they will take me is 17th June, (F me!!! thats nearly 3 weeks away) How can i blag the tax man to wait 3 weeks at this stage!!! Should I just fess up and tell them Im going BR, join the queue:rolleyes:

    I'm also very surprised by this change of tactic. I thought their line was usually "if you don't pay us we will make you bankrupt, because we can."

    Here is the full "letter" that was hand delivered..

    Dear Sir,

    DEBT £14,592......Self assessment

    Following my earlier letter, I called to collect the above debt or levy distraint on your goods and assetts. I was again unable to make contact with you.

    You must make payment by (then a big blank space:rolleyes: )

    If you do not I will strat (yes it really does say strat, not start:rotfl: ) proceedings in the county court. I will apply for judgement to be made against you and you may have to pay the legal costs of this action.

    If you believe there are reasons why I should not proceed or you need help and advice (:rotfl: ) please telephone the number above and ask for the distraint section quoting the reference number above.

    Interest continues to accrue on amounts paid late, and the amount shown above includes interest due up to todays date.

    Yours faithfully




    Recovery manager.

    I know this is the real deal as this is the same guy who levied agains my goods for VAT debt many moons ago at my office (ah those where the days)

    Hi ITBS,

    Is there anything of value in your house that is solely owned by you? If not, then as unpleasant as it must be, the HMRC haven't really got that much of a hold over you. They're only looking for things of value, usually motor vehicles, and they're limited to what they can take anyway.

    They're also obliged to co-operate with you if their visit would cause distress to another family member, i.e. your wife.

    You're certainly in a difficult situation, but is it as bad as you think? Have they actually been inside the house yet, because they're covered by the concept of "peaceful entry" in the same way that bailiffs are. They can get in with a Court Order but apparently that's rare.

    Hey ITBS,

    Things are not so bad if they're threatening legal action. It'll take weeks to get a summons before the County Court, and you'll be bankrupt by then, so it won't do them any good.

    I wouldn't be tempted to pay them anything either; in the overall scheme of things it won't make any difference to the outcome, and you'd be better off saving the cash.

    They have not been in to my house (yet.....)

    The car I'm assuming they cant take as its on HP anyway and the other car (my taxi) although owned and paid for 100% by me Im confident they cant take as its my only way of providing for my family.

    Just bricking it (excuse the phrase) do I ring them or sit on eggshells for 3 weeks????

    Nearly missed out on a parcel before cos I didn't want to open the door:o

    Also would hate to go out and see the X5 clamped in full view of my neighbours........

    That is a difficult question.:eek: :eek:

    I don't like not being in control of events, and if you just keep your head down for 3 weeks then you won't feel any peace until you've declared bankruptcy; not an enviable position to be in.

    The problem is, what do you say if you phone them? You can't offer a repayment schedule, or I assume you can't, I wouldn't mention bankruptcy because that might prompt them to speed up any action they take against you.

    I think on balance I would phone and try and convince them that you should be able to start making payments in about three weeks, and would they hold any action until then. They probably won't agree to, but can't think what else you can do really, apart from ring the Court and tell them you can make a cancellation at any time, at short notice.

    That reminds me; dentist.:eek: :eek:

    Im off to the gym to de stress.

    When I get back I will ring the court to advise re last minute cancellations and attempt the forms online...........

    Hope the mouth's not too sore rich??
