It'll be worth pestering the court for a cancellation...as I said in your other post on the day I petitioned at Liverpool the clerks were complaining about the increase of appointents not kept for bankruptcy petitions....

If your attempting the forms online remember to print 3 copies off (liverpool asked for this with me...1 for the judge/1 for the OR/1 for you)
and with the online form filling SAVE OFTEN as sometimes the pages can crash meaning you loose what you've typed

At last!!! a bit of good news. Phoned liverpool court and asked do they operate a short notice cancellation system. Point Blank NO
Can I go to another court and wait all day to be seen...Point Blank NO
Explained there was no way I could wait 3 weeks to go BR, HMRC are making me and my OH ill, is there nothing I can do, I will travel anywhere, do anything.... After a few mins on hold I have a new appointment. 5th June:j .

    Thats next Thursday!!!!!!!!!

Am going to ring HMRC in a bit and tell them that I am sorting all my finances out and I will be in a position to settle this debt in 14 days (Not telling any lies, just not telling them Im settling it with BR:D )
If they refuse to give me breathing space I will advise them that I have no assetts, they will make my OH ill (who is already on medication) with further visits and suggest they proceed to their next intended action, by which time I will be BR.

So weird I feel glad and absolutely rock bottom at the same time:confused:

Best get cracking with my forms......
  • Great news ITBS:T a little persisitance paid off.

Edit: i thought (though i could be wrong) that anyone from anywhere can go Br at the RCJ in the Strand. Can anyone confirm this???
The first time we said hello, was the first time we said goodbye. As the angels took your tiny hand and flew you to the sky-you forever left us breathless. RIP my beautiful granddaughter :(

I think this is still the case.

My understanding of it is this:

If you have lived in a London Postcode area for the longest part of the last six months, then you are entitled to petition at either the RCOJ or the county court covering you if they cover bankruptcies

If you have been resident in the insolvency jurisdiction of a provincial county court for the longest period in the last six months, then you must petition there.

A creditor can petition through the RCOJ even if you couldn't do it there on a debtors petition yourself (such as HMRC).

I'm not going to go into the rules that apply if you have been living abroad just now.

But I haven't checked all that 100% with the Court Service/RCOJ , so they are the people to get a definitive answer from.

    Hi ITBS,

I know you wanted to avoid bankruptcy, so congratulations don't seem appropriate, but you'd have had a h3ll of a job making things work with HMRC on your back.

At least you'll get to keep more of that hard earned cash from taxiing.

    Best regards
