The price I paid for the car should be irrelevant. I was under the impression that when you bought from a garage it had to be roadworthy whereas a private sale was sold as seen.
As the spare wheel was underneath the car, it wasn't something I could see (or not in my case)
The garage is trying to get the part cheaply from a breakers yard but if he can't get hold of one, he won't pay full price for one from the dealers.

Sale of Goods Act still applies if it was bought from a trader. However, he may have been agent for a private seller (i.e. car on his forecourt but they don't own it but simply sell for a commission) in which case SOGA can be disapplied.
As for the spare tyre, my Lotus Elise doesn't have a spare tyre. However, it was supplied with a tyre fixing kit (tyreweld).0 -
TBH I think you should put more effort into sorting the problem than arguing about your rights.
ie: get the part from a scrap yard, get the garage to fit it for you.Happy chappy0 -

exactly,rights are all fair and well but if the seller sees you coming all guns blazing mentioning soga rights and small claims courts he will dig his heels in and make it hard for you....work permit granted!0 -
