bought faulty car

I bought a car two days ago and today realised that the front wipers dont work. It turns out that its a major part that needs replacing but the garage is now complaining that its costing him more than he made on the deal in the first place.

Then I got home and realised there is no spare tyre either!

The car i gave him as part ex - i removed the tax disc and sent it off to claim a refund (there was no tax on the one I bought) but he now wants to tax disc back. There was no discussion before the sale about what was and wasnt included - in fact he didnt even look at my car at all.

As far as I can see, the car is not roadworthy without wipers and a spare - is that right?

Does anyone know where I stand with this please?

    AFAIK (not certain on this) you dont NEED a spare tyre to be roadworthy but i would say that wipers are needed.

    As for the the tax disc - they didn't say anything about it at the original deal so they obviously didn't need it or they would of said something at the time.

    What part is it that needs replacing? Even if it's the motor, they're £20-£30 from a breakers yard.
  • I would say with the tax disc he is in the right

    If you went to trade in a car and the tax disc was in it at that time and you made no mention it wasnt included then that car was valued in its current state including tax

    As for the spare wheel -irrelevent unless he removed it after viewing

    The windscreen wipers are a bit different but as said I cant see it being an expensive repair and if you have had it done without his permission then i doubt you can expect him to pay an inflated cost

    He has to supply the car in a roadworthy condition. The wipers have to work and he is responsible for the correction.

    The spare wheel is one I'm afraid you should have noticed and negotiated on prior to purchase. As it does not affect the cars safety you have little comeback on that one.

    I agree that if he viewed your px with tax on it, unless you agreed to remove the tax before the deal then you are in the wrong I'm afraid.


    End result should be you give the dealer the tax disc, he fixes the wipers, and I sugest a tenner from the breakers will find you a good spare.;)

    You don't need a spare. Buy a can of tyre weld.

    I disagree, the road fund licence is not part of the vehicle, and unless the dealer specifically mentioned it, there is no requirement to include it.

    Interestingly you must have functioning windscreen wipers to be road legal, however there is no requirement to have a windscreen.
    This is an open forum, anyone can post and I just did !

    when i pointed out my car as part ex he only looked at the back of it so didnt know if it had a tax disc or not technically.

    the part it needs is according to the guy i bought it off, £200 from the dealership or £40 from a breakers yard. Its the whole piece that works the wipers thats on the steering column that needs replacing. I think he called it a stalk?

    If you drove it there he is entitled to assume it was legal. ie. taxed ( not sure about technically though)
