    I posted before, and said that I had worked in the County Court many years ago. I am not legally qualified, but I have a lot of fond memories of what happens when people read the rules but don't read all of them.

    Civil Procedure Rules - one of the purposes of these is to get cases out of the county court or a much faster passage through. If a judge thinks that a case should not have been brought then I would guess you would be in his chambers about 90 seconds - only more if he felt like giving a lecture.

    The court system was, and I believe it still is, overloaded with cases and judges do not appreciate wasting time on something that did not need to come to court.

    btw local practice, that local district judges agree among themselves, should not exist under CPR but it does linger on, so it is worth checking out with the court staff what their take is on this matter. If they snigger when they read it - walk away!

    nope still nothing back from the courts since last suggestion about how it should proceed.
    incarexpress firmly refused to comply with the judges suggestion so i check in with the courts every now and then but as stated they are under a deluge so try not to hassle them too much. will post when i hear anything!

    IIRC the order you got was actually a suggestion, not an order. There is no way to enforce it.

    This information may be out of date, so please check and don't quote me, but...

    Back in the year dot, any correspondence that came in had a turnaround time of ten days, that is if it arrived on Monday it had to be dealt with by the following Friday (10 working days) and anything not dealt was recorded. If you write in they will have to deal with it and give you a written reply. If it is like the courts I have worked in it will be ten working days to look at it, then they pass it to a District Judge to give directions then once it comes back (could be ages) then ten working days to get back to you....

    However, if you send in a letter with a question, then wait ten working days, then ask urgently about targets, then escalate to complaint, you should get a pretty swift answer. Any complaints (even about delays) usually get treated as if they are ticking.

    The 'order' was really weird. Have you asked the court staff what the District Judge actually wrote on the file? Not all of it may be passed on, but it should give an indication of his intention.
