    This is a sexist comment in that you are implying that it was a male who has commited the offence!! Where is that suggested anywhere? And, in any case, if they do not own up how will you know who to “sack” as being not trustworthy?

    Basically the Notice of Intended Prosecution will have been sent to the Registered Keeper of the Vehicle as named on the V5. They then need to return the form saying who the driver was. If you or they do not know they should say so and not just make assumptions. It is then probable that they will be “invited8 to think again and then perhaps summonsed to attend Court to explain their situation. If the Magistrate is convinced by the argument they will drop the case as having insufficient evidence, otherwise the Registered Keeper will get clobbered.

    If this is a company car then it is expected that a proper record is maintained of who was driving and when. It then covers these very situations. It may well be that whther or not the Magistrate is convinced then your OH 'semployer may see that he has not discharged his managerial function as would be expected of a competent person and he is subject to disciplinary procedures accordingly.

    My advice would be that your OH immediately implements a recording system of who has been authorised to use the car and when it is taken and returned. He should keep the keys and only issue them to whoever he has authorised and recorded as using the car.

    Not sexist, just pure lazy. Writing "he/she" or "she/he" uses up 6 key presses. "she" uses up three. But "he", only two. I was using the non-gender-specific variant meaning of "he."
  • The company should keep a log of who was driving. Magistrates take a dim view of companies that don't.

    It is the responsibility of the company secretary to ensure this happens, since it is that person who may end up getting the points.

    Nothing to do with being PC. It seems as if that chip on your shoulder still needs some ketchup on it!!! You really do have a problem that needs to have some treatment.

    I Just object to someone assuming that it was a male who was guilty of this potential offence, that's all. Just because someone says a comment was sexist does not mean it is a PC issue. You seem to have become blinkered to anything else by always spoiling for something that's not there.

    Can your OH provide evidence he was elsewhere (to take him out of the frame) e.g a debit card transaction or an e-mail record which would confirm he couldn't be in two places at once (assuming the photo is inconclusive)?

    He can be used as a personal pronoun to refer to a person who is male or as an indefinite pronoun to refer to anyone.

    The pronoun “He” is the 3rd persom singular masculine subject pronoun, where “him” is the 3rd persom singular masculine object pronoun. The plural is “they and “them” respectively.

    The 3rd person singular neutral pronouns are “it” for both subject and object and “they” and “them” respectively for the plural.

    That may be what you were trying to explain and if so I apologise for egg sucking!!!

    You appear to have edited your post.

    The use of an Indfinite pronoun is when you do not know or do not need to say precisely who or what your are referring to. “He” on its own would not fall in to this category. Correctly it would need to be used with “or” and “she” or the undefined version such as “somebody”, “someone”, etc. should be used.
