Speeding ticket on Pool car - advice please

My OH has use of the pool car a lot of the time for work.

Today he has received a speeding ticket addressed to him at our home address!

The form actually states that if this a company car then the company director should fill out who's driving and send it back. So how come the form has been sent directly to him at home.

To complicate things, OH isn't entirely convinced he was driving it that day even though he does the majority of the time.

What do we do now. There isn't an option on the form to say we don't know who was driving? I am worried about sending it to the company boss in case it "gets filed" i.e lost and OH gets a court letter in a months time.

Any advice?

    isn't it logged somewhere who has which car and when? with it being a pol car there should be some kind of record kept in case something like this does occur

    You would think so wouldn't you?

    Apparantly the car is in the works car park and staff just help themselves if they need to do banking or visit a customer. OH reckons he wasn't driving but doesn't remember who was.

    The form says that "video/photographic evidence will not be supplied as a matter of routine. It will be used in any subsequent court hearing"

    There is no option on the form either to say you don't know who was driving.

    I'm just cross that OH's name is on the form as Head Office assumed he was driving cos he is the manager!

    If you explain the problem they will usually supply the photo to aid identification

    I hope so. There is no phone number anywhere.

    Do you reckon if I leave the form blank and get OH to send a covering letter saying he is unsure who was driving, that will be sufficent?

    I would have thought that it is the company's responsibility to know who was driving. I don't know whether that responsibility would fall on a director, or will have been delegated to a manager (your OH?).

    So are the keys just lying around in reception, or something? Is there really no-one who knows who has the car at any one time?
    I would have thought that it is the company's responsibility to know who was driving. I don't know whether that responsibility would fall on a director, or will have been delegated to a manager (your OH?).

    My OH is the branch manager but staff take the car out during the day on site visits and to do banking. The ticket is for 1st May and he is convinced he wasn't driving but can't remember who out of the other staff it was (4 people)

    Basically staff just yell, can I take the car and OH says yes!

    Could it be as simple as asking the staff in a friendly voice "Has anyone been flashed by a speed camera recently?" Or would that be too naive? If the culprit doesn't own up to his transgression, is he trustworthy enough for continued employment?

    It might be worth implying to the staff that there is clear photographic evidence of who was driving, to see if anyone owns up.

    Thanks for the advice.

    I phoned the local police in the end and they gave me a phone number. After speaking to a really grumpy bloke, he agreed to send through a photo as he said it is a face-on clear one.

    Lets just hope OH is off the hook!!

    Companies who operate pool cars on this basis MUST keep records of who takes the car out. Your OH should maintain a register for the car, and get the staff to sign the car out and back in with the date and time. That way, any penalty notices can be assigned to the correct driver - it is in his, and everyone else's interests to do this.
