We are warming up an old thread again - I would advise against filing a non-performing seller because that is likely to cause further aggro and - based on my experience - may actually not be awarded to the buyer.
I am pretty sure that any claim on these grounds will be successful IF the buyer uses the system correctly (for example, if non-paying bidder claim is filed, the seller sends payment by credit card through paypal in response to cancel it). If a buyer is not familiar enough with the system, it may, however, be better to pay by a different means, neg/neuter the seller and move on.

I would think there is a good chance that the seller was entirely unaware that he had offered credit/debit card payment, and an "in-the-face" approach by filing a dispute may not be the smartest way to resolve the matter.
This is the main issue with this sort of situation at the moment. It's always a good idea to try to communicate with the seller before involving ebay. Most reasonable sellers would realise they are in the wrong and cooperate in these situations; those that don't will probably cause you trouble whatever you end up doing.

This is entirely ebay/paypal fault. If the auction listing form does not say anything about what will happen when you select paypal as an option then it is entirely their fault.

I can't remember what paypal tick boxes there are on the form (perhaps some one can enlighten me) but a simple solution would be this:

    I have a paypal personal account O
    I have a paypal Premier/business account O

    or

I accept payment to my paypal.....
    Personal account O
    Premier/business account O

This needs to be brought to the attention of a BBC consumer programme.

To explain in great detail what each category involves would take ages. How do you precis the requirement for accepting cheques for instance? Would you have to say that you need a UK bank account set up to pay cheques through it? The other misunderstood category is 'credit cards' I've come across someone who ticked it but had no idea why. That would need an explanation that the seller would require a merchant account with a UK bank etc..

Really though, if a seller hasn't read terms and conditions when they sign up for something they're not goiing to read the small print when they list something either.

    .

When you sell on your selling page the tick box by 'I accept paypal' says:

PayPal enables you to accept credit card payments in multiple currencies from buyers in 45 countries worldwide.

PayPal payment notification will go to: Edit preferences
No account needed. Fees may apply

The 'edit preferences' bit is highlighted and if you clcik on that it shows all the credit card symobols (as it does on the selling page when you tick that you accept paypal).

The word 'fees' is also highlighted and when you click on that you get an aexplanation that says "PayPal charges Premier and Business accounts to receive payments. Personal accounts are free, but may not receive debit or credit card payments."

As I have said (edited so maybe you missed it) there are tick boxes (you suggest this in your answer too), it would therefore make more sense to provide the user with appropriate tick boxes like this, there would then be no mistake about what the seller is prepared to accept as payment.

I accept the following methods of payment

    Cheques _________________O
    Credit card________________O
    Cash_____________________O
    Postal order________________O
    etc
    Paypal:
    personal account____________O
    premier account_____________O
    business account____________O

Where 'O' is the tick box.

Seems to me that you are defending shoddy underhand business practices.

Not at all, underhand would suggest to me something that is not clear when you sign up for something. However someone choosing to ignore terms and conditions, or not bothering to read them is entirely different.

*obviously, on the listing.....when the buyer views it it will say respectively what type of paypal account is offered, it will also say if it is a personal paypal account...."this type of paypal account cannot accept payments directly from your credit/debit card, you will need to fund *your* paypal account prior to paying for this item"

It most certainly underhand if as you suggest, the form does not make it very clear what the consequences are for using a personal account....from what you wrote, it doesn't. And there is no excuse anyway for not doing it as I suggested.....something you ignored.

    I don't undestand this

what it should say is this

"PayPal charges Premier and Business accounts to receive payments. Personal accounts are free, but may not receive debit or credit card payments. If you select this option you will be **required** to upgrade your personal account to a premier or business account, in the event your buyer wishes to pay by credit/debit card, if you refuse to upgrade you will possibly lose the right to continue to buy or sell on Ebay"

That IS more clear, but I still prefer my other suggestion.

I do not get any tickboxes for personal account, premier account and business account. Just a single Paypal one and one for credit cards. I posted a screenshot of what I see in the auction setup in the earlier thread that went over this issue.
