hi thank you for all of your kind advice. My God it has helped just being able to get it all off my chest. Things are getting really bad at home now- has anyone got any ideas of how I can write the letter as it needs to be done soon- I just don't know how we can live another 28 days together I really don't!!0

Sorry to hear about your situation. Sounds very stressful.
Maybe your council could give you guidance on what the letter should contain. Considering his name isn't attached to the property I'm surprised that you have to give him any notice at all.
I'd suggest you include the address of the property, both of your names, the date on which you give notice (i.e. today) and the maximum date of departure (28 days time). Keep it short, formal and emotionally detatched. Something along the lines of "Please accept this letter as your 28 days notice for departing the specified address."
Give a copy to him, keep one for yourself and send the other to the council.
What's your relationship like at the moment? Is it uncomfortable or intimidating? Could you or your son be at any risk? You don't have to put up with any unacceptable behavior. Other things to think about, do you rely on him financially? If so will he continue to provide support?
