driver jumped red light, crashed into me. Was uninsured

    I was an illegal driver but she was (maybe is) a Careless Driver. she could have killed someone... Many students were crossing that area at the time... She jumped a red light on a Very Busy junction, does it get more Serious than that?

    The car has Tax, Mot. Ive a got a Clean driving license and I Never drink drive... but i didnt insure the car......again my bad (it would only cost me £15 to insure it for 1 day -short term insurance...:mad:)

    Ive learned the lesson here and i say it Again, I will never drive uninsured not even if it is a 5 min journey

    ...and I STILL would NOT drive without insurance. 'But this was a one off' might absolve your conscience from guilt now, but not if you'd have seriously injured someone, or god forbid killed them. The long and short of it is you have broken the law. Pay for the damage yourself.

    Insurance:

    Court case, points, fine and increased premiums in the future. If your mother gave you permission to drive the car knowing you were uninsured then she might end up getting prosecuted too. If she didn’t give permission then you could end up with “taking without owners consent” being add to your charge sheet.

    The accident:

    The liability of the woman who hit you does not depend on your insurance status. If she was at fault then her insurance company will pay for the damage and injuries sustained by you.

    If you jumped the light then the MIB will pay for the damage and injuries sustained by the other car and may recover the costs from you. The MIB will not pay for the damage to your mothers car. If you didn’t have permission to drive the car your mothers insurance might pay for the damage to her car under the theft part of her policy BUT some policies exclude theft claims where the thief is a member of the family and has the keys.

    I think legally theft involves an intention to “permanently deprive the owner”, it’s probably the case that you didn’t have this intention and to claim you did to get an insurance payout could well involve you in more serious criminal charges.

    For Iamthesmartestmanalive….. Obviously none of the above applies if you are black/asian as we have special laws for ethnics who, it is well known, never buy car insurance or follow any of the other laws of the road. You will be hung, drawn and quartered/sent back to where you came from/let off and given a government grant (delete as appropriate to suit your own prejudices).

    You drove illegally, she drove carelessly - 2 wrongs don't make a right. If you want an insurance company to pay for a car accident you have to pay for a policy.

    I know this is VERY harsh, but what if you had hit someone who was left disabled for the rest of their lives. They WOULD NOT have been able to claim against your insurance company. What if they had children whom they needed to look after?.......

    The MIB exists to ensure that someone injured by an uninsured driver is in exactly the same position financially as if they had been hit by someone who was insured.

    Kill someone??! The other driver could have killed someone herself!! If she hadnt crashed into me it could have been another car, or worst a pedestrian!

    If i had done the 1dayinsurance I still would have been on the road and the crash would still happen!
    Doing the insurance to cover me for that day wouldnt have changed anything as she was a very careless driver

    I don't think so, taking a slightly skewed view, take the uninsured car out of the equation, the vehicle that would have been behind said car would have taken the hit from the red light jumper, she was totally responsible for the accident and her insurer should pay ALL costs and she should be prosecuted.

    I am not sticking up for the OP, as no one should drive uninsured, and I agree with all of the comments relating to that, but the red light jumper would have hit the next vehicle and that one might have had children in it, although the OP did say the following vehicle was a lorry, so the red light jumper might have been killed,one problem,(red light jumper), solved!

    How can an illegal driver (because thats what you are/were) complain about someone who is legal?
    How do we know that you didn't go to early at the lights, we have only your word.
    As you have already proved yourself criminal enough to drive without insurance (& it sounds like its far from the first time) do you really think your word stands for much now?
