    You know what - if I knew which insurance company it was, I would send our receipt to show we had paid for a partial replacement. I have no idea unfortunately how I would find out what insurance company she is claiming from!

    is there a nice man at sofa workshop who can tell you??

    regarding flea treatment, isnt also the point that even if they know and you know they know you had cats there, surely they can only charge for necessary items, if there are no fleas,,,, no treatment is necessary. thing is, how do you prevent her visiting and coming back and saying, 'ive been bitten so i know there are fleas'.

    I'd just add the following on to end of the letter ... 'Therefore we request confirmation by 28th May 2008 (as originally requested) that we will receive our deposit of £975 less deduction of £156.72, equalling a total of £818.28. If we do not receive this confirmation via email by 5pm 28th May 2008, we will commence legal proceedings against Mrs LL to recover monies owed to us on 29th May 2008 together with any interest and legal costs without any further notice to you'.

    I guess we can't prove that. I would hope that all the other eveidence would go in our favour and support our case though......

    Not trying to cause an argument here, but in the case of the flea treatment...I would most definitely have this done if I knew there had been any cats (or dogs) in any property that I let out AND charge the exiting tenant for it.

    Reason being, even if there isn't any evidence of fleas there now, the b0ggers lay eggs that can lay dormant for months waiting for the right conditions to hatch and get active.

    Believe me, this has happened in a property we bought a few years back. No evidence of fleas, but as soon as there was a bit of activity in the house, out they came in their hundreds...yeeeuukk...so, how would you feel if you were a new tenant and later found the place crawling in fleas...no doubt you would blame the LL and not the previous tenant...

    Thats fine, and I agree, however my arguement is, this is not something they can decide to introduce after we have moved out. It wasn't written into the contract or mentioned verbally. If they can decide to add this after then where will it end with 'extra' charges?

    I always deflea every house before I move into it as my dog has an allergy to fleas. You can buy some treatment for the house, from the vets and it only costs a few pounds.

    RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

    I wouldn't ever expect my tenants to have to deflea a house I was renting to them...I would be mortified!!:eek:

    To sexki11en..I do see your point, but didn't you say somewhere on this thread that the LL /LA 'say' they had no knowledge of the cats? If in truth they did not know of the cats until you moved out and they found evidence i.e, the damaged furniture, then morally, they are as far as I can see perfectly within their rights to de-flea and charge you for it.

    With the greatest respect, I think you need to step back a bit...they aren't going to add any spurious 'extras' on or they would have done this by now wouldn't they? :) The deflea charge is reasonable and down to you and I think deep down you know this, as is the damage to the sofa. That doesn't mean that I think the LA is entirely blameless tho...far from it...

    What they are guilty of, and this is a basic in my book, is not stating fairly and squarely in the contract that the cats were either allowed or not, and any resultant damage/infestation/whatever would be down to the tenant(s) to pay for.

    As for the cleaning etc with the best will in the world, someones opinion of 'clean' will certainly sometimes be far removed from another persons. Again, the level of cleanliness that the property is in when handed over then handed back should be clearly indicated in the tenancy agreement from the start and most definitely written into the inventory.

    The thing about the charges for the sofa is a bit odd...I can't see why they couldn't have researched the costs properly as you have done. It seems clear to me that they either (1) couldn't be bothered or (2) thought YOU wouldn't be bothered! ;) As a LL I would want at least a full set of covers to replace the damaged ones, but other LL's would press for a complete replacement. A bit of negotiating needed directly with thje LL is needed here I think.

    I do wish you luck with this. I can see that both sides of this argument has valid points and there will have to be a certain amount of give and take to settle this.
