    Aghhhhhhh this is just stupid now. He said, she said, they don't even know what their own members of staff have said fgs!! E mail from them in response to my e mail.

    I reply to your email as follows;
    Thank you for telling us Sofa workshop have a copy it might be quicker for
    us to get from them as it didnt arrive in todays post and I tried to ring
    Landlords parents but no reply.
    Yes, it might be quicker mightnt it??? (HOW bl00dy useless?)

    I have been told flea treatment necessary not preventative
    Who told you that? No one told us! Whatt proof do you have? If our cat's don't have fleas, how can the flat?

    Do you have access to fax no and we will fax checkout
    You already have it as have faxed documents to me!

    In respect of remaining deposit this was the figure I was given by accounts
    as there was some outstanding rent I will ask accounts to forward the
    figures tomorrow as they have now gone home.
    Fair do's, if forgot about that and it wasn't listed (not that we didn't pay our rent, we did, we stayed a few days over the tennancy with permission due to the BH)

    In respect of charges your tenancy states you must return the property in
    the same condition with the exception of fair wear & tear.Landlords are
    legally entitled to charge for cleaning and removal of fleas.
    But the tennancy DOESN'T state that they can charge for fleas. Anywhere. I read and re read it!


    Btw, these are not comments I have made to them - just what I am currently thinking.

    My concern now is going through the courts. I will do it, but if we do lose, how much are we likely to have to pay out in respect of their charges?

    Couple of things - did you check your TA for the clause I mentioned previously about costs of pest control treatment at the property during the Tenancy ( remembering what Bungarm says about flea treatments)?

    Yes, sorry I forgot to come back to you about that one. There is NO clause or mention of pest control in the TA. The LA seem to be under the impression that the LL can LEGALLY charge for that regardless tho (see above)

    Have you personally checked with your Council what their flea treatment charge is (may be on their website)?

    Does your cleaning firm have the name of the person who was at the property and pronounced themselves satisfied with the standard of cleanliness when they had finished, and would they confirm it in writing if it wasn't in the email reply they sent to you?

    I doubt they have the name. The person in question tho was my OH. He was right tho - it did look better when our cleaners had been than when we moved in!

    I'm pretty sure that if it's the small claims court (which it will be) then you are not liable to pay costs if you lose. Although you will lose the amount you have to pay to set it up.

    Someone correct me if I'm wrong though.

    Tell me about it. My ex-LL lied in the final letter she gave me saying she has said this and done that, lied to my solicitor when she wrote back to him. I think she actually started to believe what she was saying. Deluded cow! (Sorry if this offends anyone but she still gets right on my nerves :mad:). Didn't get her anywhere in the long run though .. ;)

    Hey Tori. Nothing at the moment. I intended to reply to the LA asking for our undisputed amount back and filing the online court papers but family issues and work have stepped up over the last few days.

    I will get a$$ in gear in the next few days and update you all, I promise

    Right - no progress made until today. ALl I have done is responded to their email where they asked me if I would like the undisputed £200 back (why on earth would I not???)

    I also requested proof of fleas in the property (council inspection) quote for the flea treatment (as they are claiming £94 but the council website lists domestic as £88 - they are trying to charge me for commercial) and a proof of the sofa receipt (still not received!)

    More updates to follow as I submit the moneyonline claim.

    Its my understanding that they must give you a landlords address but not a telephone or email contact for DATA protection.
    We are just starting action against a LA - aspire home lettings.
    My partner paid his rent every month on the right day except once due to a banking error. There were a number of items in the flat including an old mattress covering a stain on the carpet. He's a bloke so didnt winge.
    When I got work in a lettings agency, he decided to move in with me.
    I too anticipated probs knowing what my agency were like. Everything was fine though. They guy checked the flat on leaving and asked about the things my partner had left which werent his. All was explained and the guy said he'd get his deposit back. Happy days.
    Six weeks later, no deposit....My partner called repetedly and eventually received a cheque. £45 for cleaning the stain hidden by the mattress, £45 for arranging to have the stain removed...£35 late payment fee ( was late by less than 24 hours) £99 for closing the account!!
    I know myself there is no cost to unchecking the LET box on the property account!!! so £99? Banks cant get away with unreasonable fees. Why should they.
    We will fight tooth and nail.
    USE CAUTION WITH THESE PEOPLE. Ive been on the inside and they are greedy and ruthless!
