I thought a ban for driving without a license was a common thing - but this is silly as they were never licensed to drive in the first place, so the ban does nothing.
I had to take driving lessons, pass a test, apply for a full license, and buy insurance to be allowed on the road - I do not see why someone should think they have good cause to not do any of these.
I too would hope someone who has no respect for the law would go to jail. Unfortunately realistically it won't happen so your brother may have his freedom unfortunately, and he may commit similar offences again as there's no real punishment.0 -

Driving otherwise than in accordance with a licence (or no licence) is maximum £1000 fine, possible disqualification, and 3 to 6 points.
Driving when disqualified is up to 6 months in prison, maximum £5000 fine and minimum 6 points.
So banning someone opens up the possibility of prison and a minimum of 6 points, when they do get a licence. Even if you don't get prison the fine is likely to be much bigger.
And before anybody mentions that what is the sense of giving someone points if they don't have a licence, the logic is that as soon as they do get a licence the points kick in, and then they will be driving around with 3 or 6 points on their licence, so as a newly qualified driver, inches away from their licence being taken away and needing to take a re-test.0 -

So does this mean, he passes his test (eventually), gets his licence then instantly loses it as his 6 points kick in?

Because as I posted 2 posts up, if you get caught driving whilst banned the courts have the option to send you prison (or other community punishments), but they don't have that option if you are just driving without a licence.0 -

They won't even put pedophiles in prison, I doubt there's any serious risk of someone driving while disqualified going to prison.0 -
