What happens after the 4 days are up Kaia. What did you actually send them. Is it going to court after.

I issued the claim at my local court on 10th May, well it says 8th of May on the claim form N1, but was told it was deemed to be served on the 10th May 2008
The court said they have until the 26th May to respond.

    Under that it says....

    The defendant may...
    1. Pay your total claim.
    2.File an acknowledgement of service.
This will allow the defendant 28 days from the date of service of your particulars of claim to file a defence or contest the court's jurisdiction.
    3. Dispute the whole claim.
The court will send you a copy of the defence.
4.Admit that all the money is owed.
The defendant will send you a completed admission form and you may ask the court to enter judgement using the request below...
5.Admit that only part of your claim is owed.
The court will send youa copy of the reply form and you will have to decidewhat to do next.
    6.Not reply at all.
You may ask the court to enter judgement using the request below....

Did you read what M COLAK wrote for you a little way back. He said if you read it then PLEASE take note. Just confirm you have read this.:D Page 44 i think or 43

    it said this

Kaia if you are reading this then don't (i repeat don't) apply for a judgement by default until at least the 31st May (3 weeks) as then it will seem that you have given them more than adequate time to respond and the Judge will rarely let them get the judgement stayed if they have had 3 weeks previous to this.

No what Kaia has is an ongoing court action where the company are failing to respond or acknowledge the case. As the company has received the documentation then it is assumed that they don't wish to defend the case. Just sent off my 1st letter today after much help from m.colak (genius) and tiggrae (also genius), i never realised i'd paid so much on ppi (that i didn't need as i'm in the forces) they worked everything out for my including the fact that i'd overpaid loads when i settled the loan, i can't believe the banks have been getting away with this! makes my blood boil - thank god for this site, maybe we should petition for martin as next chancellor!

I have started writing my first letters to the loan companies: First Plus, Loans.co.uk, Endeavour finance and First National, yes, have been a serial loaner!!!

First Plus/Loans.co.uk - waiting for SAR from Loans.co.uk and final reply from First Plus before I ring FO! as none are taking my complaint seriously.

First National - still havent had a reply from my first letter

Endeavour Finance - waiting for copies of my redemption settlement

My question is can I go to the FO with three:cool: seperate complaints from these sharks?
Each ppi is a separate claim and the FO will see them that way, as to whether they will look at them really depends upon when you took the loans out - other than firstplus I think the others are independent lenders which will only have come under the compulsory jurisdiction of the FSA on 15th January 2005 - if your loans redate this then the FOS will not have the jurisdiction to look at your claims

I know, it really is scandalous that they have continued to get away with this for so long, it does make you angry doesnt it. Very angry.

Anyway, I'm glad you got your first letter sent off , I will follow your case with great interest and hopefully will be reading YOUR success story on here VERY SOON x x x

Nighty nite all I'm off to bed now
