Hi m colak i have read a few of your replies and sound pretty good at advice, maybe you can help me? i have taken hfc bank to court online which i thought i had won, they failed to reply and i issued ajudgement by default,i received a letter from thier solicitors today saying that they didnt reply on time due to an error by the solicitors and they were applying for the judgement to be put aside! i am sick of it all really dont know what to do,can you give me some advice ?

ok don't worry to start with. This is simply a delaying tactic usually. Go with all your paperwork on the day and make sure you have details such as how much a typical days pay is and how much it cost you to travel including any other incidental costs (this is so you get at least your expense's back). Hold in there 9/10 times the judge will aknowledge the fact that they responded to the judgement but make sure that you highlight the fact that they have had ampall time to respond to the case previous. Worst case is the judgement will be stayed and they will be given another 14 days to get a defence together for an actual court case. Its at this point you start asking for the details of the person whom sold you the loan and what training they had received in relation to the selling of the insurance (make sure you quote CPR 18.1 at them (request for information pertaining to your case)).

Just had a pm from petermb but again won't look or aknowledge it.

Thought i'd just look (curosity dictates). I'm just a "lucky amateur" so far so everyone just beware. Thanks for the compliment petermb.

I took out a loan from Barclays in march 04. Agreement states:
    Cash Loan Premium Loan
    Amount of Loan £14000 £2335.63
Total charge for credit £2625.28 £437.81
    Total amount payable £16625.28 £2773.44
    Monthly repayment £346.36 + £57.78 = £404.14
    Number of repayments 48 48

'You may end this agreement at any time, if the cash loan, premium loan or barclayloan protection is ended then the whole agreement will end. You may then take out a new loan application for any outstanding balance and for any further money that you require. We will assess any new application on the day it is made.

I paid my first monthly payment in May 04 I paid my last monthly payment on 3 dec and cleared the loan fully 6/7 dec 05, after making 20 payments of £404.14, the settlement figure was £10269.69.

can anyone give me any advice? as i am confused as hell! Don't understand what the premium loan is about???

    Hi Sarah

Have just read your msg re barclays.

Have just heard from Financial Ombudsman that they have upheld my complaint against them

    Took our load 2002 £5000
    Refinanced 2004 to £10000
Refinanced 2004 six months later to 15000:eek:

All these had "premium loan" amounts added or PPI they were all financed over the phone and was told that the loan would not happen unless I took out PPI. Also was self employed and suffered two medical conditions which would not have been covered. After writing "thank you Martin and all those others who have given information on here e.g. M colak GT568 and tiggrae to name a few" to Barclays was told basically on your bike or the phrase they use which really makes me mad "sorry this is not the response you were expecting"  .

Anjyway to cut a long story short FOS have upheld my complaint and am getting back all PPI plus associated interest plus 8% about £9000.00:rotfl: :rotfl: :rotfl: :rotfl:

Please do not be put of from these sharks, with time and patience the little person can have a voice against these giants.

Just as a note Petermb is helping me at the moment with a Business Claim that was too difficult and awkward for me to handle and it is now with Solicitors and going to court for £16,000.00 plus we are not paying anything for this ourselves. Everything he has done was as promised. Yes I know he gives little snippets on the messages and yes I would have sorted it if I could but was unable to. So I say a big thank you to Petermb and also all those others on here who spend so much of their time helping others.

    Good luck:beer:

Have today heard from Financial Ombudsman

It's alright but would take a dictaphone and ask to record the conversation:D . If they don't like that i would say in that case all further correspondance is to be carried out in writing.

I have just sent off my first claim letter to Cahoot. I paid of my loan a month or so ago. I tried to access my account online but it has totally closed down now so I can't find my figures. I took the loan out in September 2004 and it wasn't until about a year ago when I set up to view my account online that I realised I was paying over £50 a month PPI. More than I was paying in premiums!!! No wonder my balance wasn't reducing!!!
My original loan was around £5000 which we topped up with another £1000 a year or so later. Can anyone give me some idea of a ball park figure I should claim for?
I think it could be roughly 3 years @ £50 a month plus interest at 8% = £1800 plus £144. Does this make sense to anyone??

Hi, first post on here, just need a bit of advice

sent off my initial letter to FP on the basis of a single policy being mis-sold and today got a 3 page letter back stating that because i agreed to the policy at the start of the loan this wasnt going to be upheld!!
I actually remember the sales person stating that the loan could not be taken out unless i used their insurance, but they say they have recorded documentation stating my acceptance. They have said it was all clearly confirmed to me at the time and a breakdown was advised!
Finally, the guy at FP, Craig Silver, has said that he will keep the file open for 8 weeks if he dosent hear from me the case will be closed, however he has also said that if i am not happy i can go to the FOS, but before that option becomes available i can call him!

Any help would be greatly appreciated

    Thanks

Firstly when did you take out the loan.
Second, was it a single up front premium and
Third just send a subject access request off. (you will receive details of all telephone conversations and paperwork yourself) See for yourself and i bet they are lying. They will have to provide you with proof that they did not missell it to you. After the subject access then get in touch with the FOS. He can only intervene if you have had a FINAL response and it has to actually state that in the letter.

There really should be a Firstplus thread all of its own because then the FOS may realise that all of us are not lying and that Firstplus needs a large FINE
