    the defendants have to file a defence (within 28 days), this will then be followed by an Allocation Questionnaire - this is a court document which basically is asking for which court track you believe your claim should go down and which court - always specify your local county court and the small claims track - you'll also be asked if you'de like to use the court mediation service - usually a good idea to say yes !!! You can also (under court procedure rule 18 - CPR 18 request further information from the defendant - see my posts of yesterday) if after all that you can't agree with the defendant a hearing date will be set

    Thanks Laini - is it still worth asking for a SAR even although they say they don't have a record of the original phone call?

    I now have 3 cases with the FOS. I have had responses saying my form and docs have been recieved (which took a week) but what happens next. Has anyone had their cases fully concluded by them. I understand they are snowed under and may take a while just wondered what next step is. Do they just send a letter saying you win they are paying you the money, or you lose forget it? Do they give you a detailed anaylsis of their findings and give you chance to appeal if you arent happy? When they recieve your complaint do they communicate with the company you comaplin about at all to get their side of things before making a judgemnt. I probably sound v anxious but its terrible having to sit twiddling your thumbs when thousands of puonds of yours hangs in the balance. Just be nice to know what may lie ahead?

    I would say yes as there maybe notes on the file which shows your application cos surely you didnt just magic the forms to your home address and send them it should show first point of contact surely.
    also there maybe information on your account you are not aware of.

    we have been with the FOS since the new year and got the same reply as you have which means you are in the queue.
    it has taken until may 2008 to be assigned an adjudicator( we are still awaiting their decision )you will get a letter to say you are being assigned an adjudicator and then the adjudicator will write to you saying they are looking into your cases. I have been told you do receive a long document stating all the information on how they come to their decision and if successful they then advise the company on how much to pay and in a time frame to do it.
    I know someone had to wait nearly a year to receive the money.
    so it might be christmas before it is complete for us.
    the FOS received nearly 2000 PPI complaints in total last year they are now dealing with 2000 per MONTH so be prepared to wait.-sorry

    firstly the FOS assigns a case worker, they check to make sure you enclosed the final response and signed the paperwork etc. You then have to wait for an ajudicator to be assigned, once one has been assigned they will write and ask you for further informations such as the terms of agreement or ask if you want to add anything to your claim,- they do the same to the other party. They then review everything and make a decision based upon the information in front of them. This usually takes about 6 weeks

    the advance is probably the amount they've paid over to the insurance company for your ppi policy
