  • Hi Homer, yes I make you right however, my response was based on how much time there was to go and that a lawyer could action quickly if necessary. I think your idea of a 'help pack' for these cases is a great idea!! I am certainly not the most experienced with court proceedings hence I too would be grateful for any assistance in that arena ;)

  • Hi have not the will to type any more so here is a bit out of a letter I sent to Virgin Media for something else I was dealing with for myself and my mum..

    'As stated above, under the Data Protection Act 1998, 7(1) ‘Subject Access Request’ I require to see all of your system notes from my mothers account and my account and I require this information from May 2007. If you do not handle these requests for your organisation, please pass a copy of this letter on to your Data Protection Officer or, another appropriate Officer within your company. I understand that there may be a cost to me for you to supply this information which I recall is up to £10.00. Please note, my mother has signed an authority below allowing you to release the data you hold about her to me. Your data controller has no more than 40 days to comply with this request'

    What happens after the 4 days are up Kaia. What did you actually send them. Is it going to court after.

    No what Kaia has is an ongoing court action where the company are failing to respond or acknowledge the case. As the company has received the documentation then it is assumed that they don't wish to defend the case. Kaia if you are reading this then don't (i repeat don't) apply for a judgement by default until at least the 31st May (3 weeks) as then it will seem that you have given them more than adequate time to respond and the Judge will rarely let them get the judgement stayed if they have had 3 weeks previous to this.

    So if they are not defending the case and after 31st may what happens then. Do they HAVE to pay up by law.:confused:

    Well once they have passed all the deadlines, ie the 31st of the month, you can apply to get a judgement by default. The court will then file a judgement against the defendant(non-defendant) and they will be informed of when they have to pay the debt by. If they don't pay then the court will issue a warrant for the removal of goods to the said amount etc.
