I note you have not received your policy document. It should say under eligibility ‘first named person covered’.
HOWEVER, if you were not told this on the phone when you were applying for the it then, you have a case. As I have said in a previous mail, if they can't prove you received the document unless there is a part of your loan agreement which you signed to say you have received and understand the Ts&Cs they cannot enforce them. This has been an issue for sometime for insurers and the bottom line is that they have to prove it not you! And I know they cannot, too expensive to send recorded delivery etc so they hedge the bets![/FONT]Hi
I am at the allocation questionnaire stage and have received AQ from Eversheds (solicitors for LLoyds TSB) which states in section G that they are saying that claim is time barred. Should I enter into section G the reason why it is not time barred?
Also, after reading the above post, should I send a letter requesting this list of information? Although LLoyds weren't with FSA until 2005 (my loan started 2000.) Surely they must have been regulated by GISC before that and similar principles would apply.
They have also ignored my requests for a copy of the PPI T&C and I have assumed that the PPI will be in both our names as was a joint loan and does not state anywhere it only covers one of us.
Am really desperate for info as I only have two days in which to respond!

There is absolutely no need to pay anybody to make these claims or look at them.
I have had a PM from Martin yesterday evening stating that its on his "Things To Do" list and it may be a week or two before he can comeback to me.

They should have told you this verbally when you applied for the loan. altough to add, this is not quite an early PPI cancellation. I did only take the (deferred for 3 months) loan out in Feb 2006, made the monthly payments for while and then made a lump sum payment of £10,000. The loan was for £13,000). I had been hoping to pay it off completely then realised I wouldn't be able to, so could only make a lump sum. And from then on, more than a year, I've been making the monthly payments. When I rang them a couple of weeks ago to cancel they told me I had only 7 payments left to make.
My understanding of a rebate (as they called it) is that it's money due to you which is why I'm questioning whether they can keep it to take it off the loan amount. Their letter said that my loan account had been credited with the rebate. So am I reading this wrong?0 -

Just received my SAR from Firstplus and they have sent all paperwork copies and also a cassette tape of phone calls but have conveniently missed all phone calls of the time of the settlement when i complained and was objective about the settlement and actually state that no paperwork about the ppi or the rule of 78 was sent out to me at the time i took the loan out. Freedom Finance is at the top of most of the paperwork but the actual application for the loan does not have any name and address on. It is filled in by us and parts are filled in by someone else but its not the original and the ppi box is ticked for both applicants although at the time i was self employed. I note that on a piece of paper it states the phone calls and like i say the actual recording of the phone call that i STATE that nothing was sent out about the ppi and rule of 78 is missing. I have called them this morning about this and they will ring back. I wonder why they have ommitted it. Is it evidence.0

I have started the long process of reclaiming PP1 on my OH credit cards and stroe cards. I contacted Mint who sent out all statements relating to this account. They state that PPI was offered through UK Insurance Ltd. I therefore issued letter to them requesting refund of PPI. The address i sent the letter to was:

Hi
I asked for my PPI to be reclaimed as i was missold it.
I got a letter back from HSBC basically saying that they didnt believe it was and that they would not take it further.
What do i do now? I am tempted to "let it go" but only because im not sure if i can win and what to do?

How do i start with taking Freedom Finance to court. I keep getting told that they were working on behalf of bespoke Finance and that my complaint is with them although i have never heard of them before now. I realise that the FOS cannot do anything with regard to my loan as it was in the year 2000 and i have contacted FISA too and nothing. Is there not anyone that can help. The FOS are looking into the rule of 78 and checking it was applied correctly but is that all they can do. Can they not go for them as unfair terms or misrepresentation or extortinate credit. Is that something i have to do through the courts or could perhaps trading standards help or the oft. Where do i go next with the ppi. Got my final response from BESPOKE who i had no dealings with and Freedom won't discuss anything more. I am cracking up that they got away with this.0

10 Months LPI cost me £8191!!!The figures:Loan amount £23,484
Added to loan for LPI £8,340.63The Story
My repayments for the above were £615.24 pm over 84 months
£454 loan + £161.24 LPIAfter 10 months decided to cancel LPI.New Figure:
Original loan amount now £23,540.59
(Now owe more than at the start!)
Also 74 payments left @ £490.25!!! (£36.25 pm increase!)Payments Paid to Bank:
10 X £615= £6150
Extra to pay on original loan = £2041
= £8191 for 10 months LPI COVER!!!!!!We were advised that due to the amount the loan had a better chance of being agreed if we took LPI (not sure if true) and we could cancel anytime.
My advice to all is when offered LPI shop around!!
We were absolutely amazed to find after 10 months paying £615 pm we now owed more on the original loan and the repayments had jumped £36.25 pm!.
Where did we get this great deal? I hear you say.
Well let`s just say !!!!!! Turpin also had a Black Horse!!
Oh and of course we are no longer protected!!!.0
