marshallka wrote: »How do i start with taking Freedom Finance to court. I keep getting told that they were working on behalf of bespoke Finance and that my complaint is with them although i have never heard of them before now. I realise that the FOS cannot do anything with regard to my loan as it was in the year 2000 and i have contacted FISA too and nothing. Is there not anyone that can help. The FOS are looking into the rule of 78 and checking it was applied correctly but is that all they can do. Can they not go for them as unfair terms or misrepresentation or extortinate credit. Is that something i have to do through the courts or could perhaps trading standards help or the oft. Where do i go next with the ppi. Got my final response from BESPOKE who i had no dealings with and Freedom won't discuss anything more. I am cracking up that they got away with this.0

Hi
I asked for my PPI to be reclaimed as i was missold it.
I got a letter back from HSBC basically saying that they didnt believe it was and that they would not take it further.
What do i do now? I am tempted to "let it go" but only because im not sure if i can win and what to do?

10 Months LPI cost me £8191!!!The figures:Loan amount £23,484
Added to loan for LPI £8,340.63The Story
My repayments for the above were £615.24 pm over 84 months
£454 loan + £161.24 LPIAfter 10 months decided to cancel LPI.New Figure:
Original loan amount now £23,540.59
(Now owe more than at the start!)
Also 74 payments left @ £490.25!!! (£36.25 pm increase!)Payments Paid to Bank:
10 X £615= £6150
Extra to pay on original loan = £2041
= £8191 for 10 months LPI COVER!!!!!!We were advised that due to the amount the loan had a better chance of being agreed if we took LPI (not sure if true) and we could cancel anytime.
My advice to all is when offered LPI shop around!!
We were absolutely amazed to find after 10 months paying £615 pm we now owed more on the original loan and the repayments had jumped £36.25 pm!.
Where did we get this great deal? I hear you say.
Well let`s just say !!!!!! Turpin also had a Black Horse!!
Oh and of course we are no longer protected!!!.0 -

Freedom Finance is at the top of most of the paperwork but the actual application for the loan does not have any name and address on. It is filled in by us and parts are filled in by someone else but its not the original and the ppi box is ticked for both applicants although at the time i was self employed. I note that on a piece of paper it states the phone calls and like i say the actual recording of the phone call that i STATE that nothing was sent out about the ppi and rule of 78 is missing. I have called them this morning about this and they will ring back. I wonder why they have ommitted it. Is it evidence.0

:jHi all. I've been reclaiming now for the last 18
months or so. I started with my bank charges and moved on to my PPI.
I have been trying to claim my first direct ppi back for a few months and they have sent the usual letters refusing to pay etc. I started a small claims case online and received a copy of their defence a couple of weeks ago asking the court if the case could be stayed. I replied stating the inaccuracies within their response and asked the court not to agree for the case to be stayed and as a result, i received a letter from my local county court yesterday giving me a court date for July. Small victory to me.
First Direct were the only company whilst in was claiming bacnk charges that allowed it to get to the stage of receiving a date from the court. They did however, settle with me by means of a cheque 4 days prior to the court date. I wonder if they plan to do this again. The monies i am asking to be refunded is the largest of all the claims i have started, at £2300, so i wonder if this is also making them want to fight it more.
I have no problem whatsoever in attending court if they so wish, but hopefully it won't get that far. Has anyone else had similar experiences with First Direct?0 -
why are you bothering with an SAR??? To be honest I'd just write to Firstplus and state your claim, when they deny it (as they always do) make a complaint to the Financial Ombudsman, firstplus are owned by barclays and as such are covered under their jurisdiction with the FSA.
The FOS sent my compaint forms out over the rule of 78 and if it was applied correctly. If it was there is nothing else they can do so they say but now i have the sar i will definately esculate my complaint with the FOS about whether it was actually Freedom Finance who were the broker. I really don't remember. Is there any way other than what i am doing now of finding out who sold me the loan and ppi. Should Firstplus have some sort of documents headed by Freedom.0 -
When I got my bank account with Natwest many years ago (Current Plus) I was able to have the Natwest Visa Primary card as well. Thinking back however, I do not recall agreeing to the PPI that was included.
If I was to go ahead with claiming back the PPI, would I be at risk at having my card cancelled should I have a successful claim? I only ask as I know that when people in the past claimed back on bank charges, they then had their accounts closed. Therefore would the same apply with active credit cards too?
Apologies if this has been discussed already, but I had no joy when searching the forums. And obviously there are a lot of pages!!

Its against the banking code to close accounts because you make a complaint.
I dont think they will close your credit card.I am a Mortgage AdviserYou should note that this site doesn't check my status as a Mortgage Adviser, so you need to take my word for it. Hi there,
I was wondering if anyone could help please? Couple of things ...
We have wrote to our lender Paragon Personal Finance asking for a rebate of our PPI that we felt was missold to us in 2004 and they are trying to fob us off. They have said that I will have to go back to the original lender which was EasyLoans.co.uk as they handled all the paperwork relating to our application and only forwarded to Paragon the fully packaged documents after we had signed the Credit Agreement. Please could anyone help with this and let me know if I should go back to them or should I pursue Paragon as we have the loan with them?
Also, our credit agreement became an Unregulated Credit Agreement because of the added PPI as the original loan amount was for £25,000 and they added on £7,250 for the PPI. We have had problems trying to find out what our rights are with this sort of agreement - please could anyone help?
I would really really appreciate some advice please.
Thank you
P.S. There are other problems that we have had with this loan but there is too much to go into here, but basically they are offering us a goodwill gesture by reducing our interest rate from 11.392% to 10.892% which doesn't even make a difference!0 -
Hi all - I'm doing this on behalf of my Dad who I think has probably been left well out of pocket due to PPI.
Basically he borrowed 42k and 10k PPI was added as a single premium at the start of the loan. 6 months later he settled the loan and the settle amount was 49.5k.
Obviously he's paid back an incredible amount compared to the original loan and basically I think we can claim but before I start does the sound like a typical case where there is a chance we'd get some cash back. If so am I write in thinking he should be getting circa 7k back?
Just seems to goo dto be true and something that happens to other people...
Thanks0
