    Just thought i'd better let you lot know about an experience I had with the FOS. I put in a complaint, stating that I was mis-sadvised in a telephone conversation. When I made my initial complaint to the company, surprise, suprise, they could not find the call, even though I provided the company with the exact time, date, duration, and to whom I spoke.

    The FOS advised me after looking at the complaint, and I quote "It does not matter what you were advised during the telephone conversation, as the terms & conditions of the policy clearly state the appied exclusions", and to further rub salt into the wound, I asked for my complaint to be forwarded to an Ombudsman, instead of one of the adjudicators, and from the time I sent my letter (via email) I had a response within 2 hours confirming that they agreed with the Adjudicator, and without even considering any of the extra evidence I had provided.

    I will also be posting shortly a load of details for all people to consider when making their claims.
    I tell ambulance chasers where to go for a living, but am willing to help genuine claimants

    I have sent both firms my first letter to claim misselling and single premium PPI.

    The response from First plus was Loans.co.uk sold you the policy deal with them. The response from Loans.co.uk was we have looked at your file and all documents were sent out and you had 30 days to cancel your PPI we acted in your best interest. My loan was 1600pounds and I took it out in 2005 Jan applied in 2004 Dec.

    I can remember at the time the sales person was very pushy and I was desperate to get the loan to pay off debt, I still feel I was railroaded into taking the insurance so my policy would not be declined!

    I have decided to write to both First Plus and Loans.co.uk once again.
    Loans.co.uk have said I should be due a partial refund on premiums from First Plus. They are refusing to deal with me again unless I go through the FSO. Typical, enough though they were fined in 2006/7 for misselling, you would think they would handle customers with kitgloves!

    Any suggestions would be greatly appreciated!!!:mad:

    I would check for what the period of time the fine was for as it might cover the period during which you took the loan. The second point is that the loan was with First Plus then they brokered the loan or at least as intermediaries and should accept responsibility by law for the mis selling of the PPI on the loan. If however they don't refer them to the Financial Services and Markets Act Paragraph 25-27 where if they are accepting responsible then they couldn't have been authorised to carry out the brokering of the insurance policy and are remiss and therefore intitled to a full refund from First Plus.

    Thanks for replying to my post! I will wait for a response from First Plus and then send them another letter stating they should refer Loans.co.uk to FSO!

    I have checked they were fined from 14th Jan to 22nd Nov 2005 in 2006, I signed my loan on 24th Jan 2005, made enquiries for a loan around Dec 2004.

    Doesn't matter when the loan enquires were made just matters that your loan was taken out during the period they were fined for :D . Enjoy yourself at this point as you have them over a barrel.

    l think this could be a bit of good news!! The FOS have upheld OH complaint against MBNA for mis selling ppi, only MBNA have asked it go to an ombudsman we just have to hope they agree with their own staff,does anyone think they will!!:confused:

    can anyone help pleas...just had letter from adjudicant asking for details of employment/what qualifications held and what my understanding of ppi is ??? (i do work in a bank call centre and have no qualifications)...any advice on what I should send back...seems a little strange to question these things...

    help please ?????:confused:
