These clicky's here deal with the whol validity of a contract issue and still looking for the exact stipulations of a contract however this information here states the case and comes up with basic guidelines. They also contain the areas where the contract would also become invalid.

Has anyone had to go as far as starting court proceedings in relation to getting their ppi back from any provider? i am about to proceed with court action after Yes car credit (direct auto finance) refused to refund all the insurance amount and the FOS did not regulate them at the time so were unable to help. I am taking them to court under a breach of the miss representation act 1967 on the grounds the salesman told me it was the law i have the insurances after i queried the amount on the contract. This was a false statement made to induce me into signing. Has anyone been this far yet that can give me any pointers or advice on what to expect?

Help I need a bit of advice. I Sent the template letter off to GE Home Money Lending requesting they reimburse me for my ppi on a secured loan I had three years ago. They definately mis sold the policy as I didn't realise that it was only covering 5 years and we paid a single premium for the policy and repaid the loan after only a year.
They replied telling me that they did not sell me the policy it was a company called Advantage, although I never had dealings with this company and was almost certain that GE were just playing games I sent the same template to Advantage just to be certain and guess what they have no records. Advantage were understandably unhappy that GE had tried to pass the buck and tried to contact GE in order to sort it out on my behalf but were told they did not hold authority to discuss the matter. Advantage have advised me to find all copies of documents relating to the loan and ppi and send them with copy of the letter they sent me today to GE.
What shall I write in my covering letter? Is there a piece of legislation regarding companies that deliberately try to dodge the bullet? Shall I threaten them?
I have found my original documents and every piece says Igroup, which from what I can make out was the name they used to go by but does this mean I cannot reclaim?
Any advise would be greatly appreciated as I'm really no good with these things:D

No i would contact the information commisioner and let him know that you have even received confirmation of the complaint. One question did you track the letter ie registered post and are you sure it was delivered?

If you have both companies denying liability then i would complain to the FOS in order for them to get involved and get to the bottom of the current situation. Someone is responsible and until you get aknowledgement from one of them you can't proceed. As i said get the FOS involved and if they won't help inform the OFT and they will do.

    Hi all!

First time on here, only came across this site yesterday and im finding it useful already! Anyway just after some advice really from anyone who has taken out a loan with HFC. In September 2003 I took a loan out with Household Bank (HFC) and was told that due to my age (I was 25 at the time!) that without taking out PPI my application would more than likely be refused. When I asked if I could try applying for the loan without PPI I was told that it would be a waste of time and unless I was willing to take out PPI I would be wasting mine and their time. At the time I was slightly annoyed that I was being forced to take out PPI  however thought nothing of it since. Yesterday I came across this website and saw the section on claiming back PPI. I've used to template letter and sent it off to HFC today via recorded delivery, however my question is has anyone else out their been in a similar situation and successfully claimed PPI back or is this just me clutching at straws??

    Thanks!
