oping someone can help me Im new here so hoping for some advice.
I took out a loan with firstplus in 2006 which PPI was added, I complained and my complaint was upheld.
The loan was a total of: £120k including ppi which was added at the start of the loan, I was told this was essential.
They have offered me the following:
1. A full refund of the insurance premium £18000 plus interest of £3500 to be applied to my loan account.
2. A refund of PART of the monthly payments paid towards the insurance policy of £4400 (£136 a month) in a refund via cheque.
3. A refund of £500 in a total amount of 8% interest on payments made directly via cheque.
Does this sound reasonible or should I be able to argue that I could get a full refund of the PPI directly via cheque?

just look at the list of regulated activites - that is the definative list which you can take a complaint to the FOS for, against an organisation who came under compulsory jurisdiction - this came into being under statutory instrument in February 2001 (to be enacted under Schedule 19 of the FMSA 2000) SI 2001/544
therefore there are only 2 questions, does your complaint come under the list of regulated activities and did the organisation come under the jurisdiction of the FSA / FOS when the event took place (or were members of the GISC)0 -

what the difference between the adjudicator and the jurisdiction? sorry if i sound dumb!
I rang the FOS today about my 5 loans and PPI, all i was advised was they have recived correspondence form Halifax, i did email my adjudicator this week but had no response, hence the reason why i rang the call handlers, propbably should have spoke to the adjudicator direct, but never had his no on me, never mind as you said its a waiting game, lets hope, my waitinga int in VAIN.

I am just about to send my letter to Barclays asking them to review their decision not to give me a refund and thought that I would have a look through my `statement of demands and needs` to see if there was anything that I had missed.
Stay with me!
In one section it says that I said `In the event of loss of income through unemployment, sickness or accident you have told us that you want to divert any remaining income or savings to maintain the repayments on your new borrowing in addition to these existing commitments.`
To me that says that I told them that in the event of becoming unemployed etc I would use my savings to cover the costs of the loan repayment.
Despite this statement barclays still recommended the insurance.
My question is, am I right in thinking the above statement says that I would use my savings or am I completely barking up the wrong tree?
Any help or assistance would be greatly appreciated in this matter

Thanks Laini. I have, in fact, already settled the loan because of the fact that the payments kept going up and I was worried about what I would do to pay it after retirement. I'm going to write back and ask for the missing conversation and say I still think they should have sold me a "suitable" policy if any, i.e just for unemployment/sickness as I was already doubly insured for life. Also they didn't tell me about exclusions but with their latest letter they sent me a copy of the terms of the policy with the exclusions highlighted and say because I had that information I should have cancelled within the 30 days. I will use your lines about unfair rebate as well.

Hi, my son requested copy of terms and condition from Picture Financial as he had misplaced the original. On receiving the copy he found the original and compared it. The original stated total amount of PPI £8732, but the copy they send was an revised one. This stated £9530 plus interest= £16,100. If the total amount has been on the stated on the original he would not have taken it. Be aware and ensure you have received the terms and conditions applicable at the date of loan, I am hoping we have a case of mis sell.

To your question as the the jurisdiction and adjudicator thing.
An adjudicator is the person that judges your complaint and jurisdiction is about whether it is in fact something that the ombudsman can look into as they have rules and regs to follow that would allow them to request information from a company.

I have had a claim going on with E Loan since last year. They weren't helping and was messing me around so at the beginning of this year I took my claim to FOS.
I kept receiving a letter from them every month saying that my case still hadn't been passed to someone.
Last week I received a letter from them saying that FOS were not able to help me as E Loan are a company that aren't in a position to the money anyway and that my case had now been passed to FSCS.
Does this mean I have to wait another 6-9 months? this is a complete joke. Surely FOS knew this before. I am really annoyed as i was clearly misold the PPI but trying to get it back is proving to be REALLY bloody difficult. :mad:0
