Thanks to you both. I was asked on the phone about life assurance etc, and it was as a result of that conversation that the girl stated that they would only offer me the loan if I took the insurance - does that make a difference? I can;t recall her telling me that there was interest payable on it although I do remember her explaining that if I paid it off early I would get a partial refund on the insurance as well as on the loan interest itself. (I think)

I'm intending to have this paid off in December (17 months early!) so when am I best to write to them re the missold policy?
Write to them now about the misselling and say that you feel this policy was missold to you for the reasons that you have stated here. It was missold if you were told it was not optional etc and if they do (as they may do..) write back and say "you signed" then send the second letter and it may be all that is needed. If not they will probably send out a final response to you (all this has to be within 8 weeks or when you get your final response if its before 8 weeks) and then you can take your complaint to the FOS. They are upholding most complaints like this if the sale was made after 14th January, 2005 when the FSA rules on PPI came into force.

Good luck. If you need any more help then just shout.

No, sorry niemowle, you typed in "massage" instead of "message" and i was just pulling your leg. ;) Sorry if i confused you here. It was just a joke.:o I hope you have not taken offense.

Have they telephoned with a figure of what they are paying you yet. Let us know when they have and someone will no doubt check it for you. They will come up with a figure (i think) and then before accepting get it posted with all the details again on here and hopefully Tiggrae will be on soon and she will be able to check it through.

Ahh yes, just remembered Endeavour letter.... We may (no-one can confirm as there is a debate on this one) have stated some not truths here about the unfair rebates thing. Well, i think you may have a reply on Tuesday and if not then i would not mention the FOS again in the next letter but mention that you will take it court instead. Maybe that is what you should have done in the last letter. They seem to know that FOS will not look into this and we have yet to find that one out for certain so i would definately mention the courts and you need to state the laws in your letter as well so they know you have taken legal advice. I will be back on tomorrow and will try to look through old letters of mine where i had to mention all these things and get back. (tomorrow though as i sooo tired...)

They will not get away with it...
