Hi sorry was working again:rolleyes: and then had some dinner. Needed fuel. Unless you are in financial difficulties unfortunately the FOS won't speed up their routine. I would suggest if you are starting to be in financial hardship then let the FOS now and they might hasten your case.0 -
Hi everyone,
I'd be really grateful for some advice about whether to continue pursuing my claim for PPI reimbursal on a graduate loan I took with HSBC.
I sent my first letter at the beginning of April and my complaint was that I had made the salesperson aware I was on an 8 month contract at work (he saw the contract!) but he still recommended the cover for employment and that he didn't make me aware that it was optional cover.
They responded today saying they didn't uphold the complaint. This is because they have a copy of the form that was filled in by the salesperson saying he had advised me to take out PPI for unemployment, sickness and death and that I understood the advice and had a copy of the terms and conditions. They have enclosed a copy and it was signed by me at the time although I wasn't given a copy. Also, that there was no evidence that it's optional nature wasn't explained.
They are suggesting that as I signed to say I had the terms and conditions this would have explained that unemployment from a temporary job wasn't covered and that it was optional. They've therefore said if want to take it further to go to the FSO.
I honestly can't remember being given a copy of the advice form and usually my record keeping is meticulous but I can't prove it. Without it I didn't know exactly what I had signed up for or that I was meant to have a copy of the Terms and Conditions because again I don't think I was given a copy (but the advice forms shows that I confirmed that I did have them).
The whole thing was so rushed that my copy of the loan agreement hasn't even been signed by me! Nor has my copy of the PPI been signed or the box ticked. On their copy I obviously have signed both bits, which I'm not disputing but in their rush to get it filled in the full implications weren't explained.
Basically, I'm wondering whether it is worth pursuing the claim when they have an advice form signed by me confirming I understood all the implications and that I should have read the Terms and Conditions properly? Is it worth arguing that it was all so rushed that I signed it on their advice without getting proper advice or will that simply be dismissed as my own fault?!
I'm feeling really stupid for signing the advice form but I didn't know at the time that the 'advice' I recieved was wrong!
I'd be really grateful for any help.0 -
Can anyone give me advice as to my next move. I have sent off the template letters to Tesco finance regarding PPI on a loan in joint names. The PPI was in the form of a single premium but covered only one borrower. I complained that this was unfair and requested refund of my premium. Tesco wrote back refusing any refund but have canceled the PPI at my request.
I also sent a letter to MBNA regarding PPI on my credit card they sent me back a reply stating that i had ticked a box on my initial application and on the basis of this i was not mis sold PPI. This was their final response0 -
Thanks
where is the box so I know where to look for it on the agreement -we signed nov 2006
going to have a look
No there is no tick box it just says other financial information section
you have applied to purchase pppi the cash price for this is 17,143.00
this includes insurance premium tax at 5percent
????
It's on the right under a box where you sign for the loan, you have to sign twice, once for the loan and once for the PPI
FirstPlus are crafty b*****s. I asked for copies of my conversations that took place during my applications and I've just had a letter from them today enclosing conversations where the loan and ppi had already been agreed and they were just calling to complete. These are no good to me - I want to hear how pushy they were! I'm claiming that the policy shouldn't have included life cover as I had adequate cover with my death in service but they state that they recommended the insurance based on a lack of other insurance that the PPI did cover. It's not my fault they didn't have a suitable policy!
What does anyone else think, should I keep pushing?0 -
I'm a bit confused ( a regular occurance) if you try and claim compound contractual interest, do you (can you) also claim the 8% statutory interest and if so is this on the total of premiums + cci or on each payment +cci? I hope I haven't confused everyone else with that, lol.
This is on a credit card.0 -

Hi you best start by asking for a SAR from the HSBC this should have all the documentation you need and then we can start working from there.0 -

Sorry the same as above until you have sent off for a SAR then you don't know where you stand it will contain all the information that you will need to fight the case whether its via the courts or via the FOS.0
