Hi everyone just been resting my eyes after a busy week however just had a pm from Petermb saying that he wasn't posting anymore. Oh well not really bothered as he didn't help that much.
Actually was that bored i actually went and look at his last posts on several threads and they have all been "You may be able to challenge the loan itself". Hmmm if this doesn't sound like trawling then i don't know what is. Petermb if you read this you will know from previous that i don't answer and will not answer your pm's as i believe that you come on here to serve you own interest and rarely post anything that helps other people. If you had you wouldn't have had such a response. If you wish to complain do so, don't pretend that you have been doing us all a favour in the past.
I have to be honest, when I first started looking into reclaiming my PPI and using this site for help, I knew nothing, and people like mcolak have been so helpful and in a very genuine way, I feel so much more informed and this is what this site is all about.
On a few occasions I have posted questions and had vague responses from petermb who then sent me a pm to say he worked for a company reclaiming PPI and was prepared to help me, I did not respond because I thought although I believe there is a place for this type of thing and some people may want to use them , I agree with mcolak that he uses this to serve is own interest and rarely posts anything informative.
On here everyone helps everyone else, no question is stupid, you can ask anything we are all here to help each other, theres nothing "in it" for anyone.
Mcolak, I must say, if it wasnt for your help I wouldnt have got this far, and I genuinely thank you.

Hi guys. I've been a regular reader and occasional poster on this thread for many months now. I've currently got my own claim in against Halifax :mad: with the FOS.
Much of this site runs on the goodwill of people such as MColak and several others who voluntarily spend a lot of time helping the rest of us out with our PPI reclaims. I don't think that Petermb was operating within the spirit of the site, which has never been about making a profit from other members.

Been reading through all the bits and pieces of paperwork we found in the file up the attic and thought it was worth mentioning that on the Freedom Finance folder I found, it states We are licensed Credit Brokers forAuthorised Banks FULLY observing the Finance Industry Standards Association (FISA) Code Of Conduct so you can enjoy peace of mind!
These are just a few of the points on the FISA website.....
Members and their Intermediaries will at all times comply with all legislative requirements and
with all Directives issued by the Association relating to their conduct or the manner in which
business is handled.
No Member or its Intermediary shall act in a way which is likely to bring the Association or credit
industry into disrepute.
Members and their Intermediaries will at all times be transparent in their dealings with potential
and actual consumers and provide full and early disclosure of all contract terms and conditions.
No Member or its Intermediary will misrepresent, even by implication or omission, any term or
condition of a proposed contract.
Members and their Intermediaries will not permit consumers to sign blank forms or any form or
document which has not been fully completed in ink.
Members and their Intermediaries must provide their consumers with appropriate and accurate
advice which must be neither false or misleading.
Members and their Intermediaries will not use sales techniques relating to optional insurance
products such as payment protection policies which might encourage consumers to take out such
cover in inappropriate circumstances. In complying with this requirement Members and their
Intermediaries shall have regard to the consumer's circumstances and have particular regard to
restrictions or exclusions contained within the relevant insurance policy.
Members and their Intermediaries will use their best endeavours to ensure their consumers fully
understand the terms and conditions of any contract, in particular the consequences in event of
default. Where there is doubt as to the consumer's ability to fully understand the nature of the
contract the Member and/or their Intermediary will ensure the proposed Lender is fully informed
of that doubt and the reasons therefore. Members and their Intermediaries must explain clearly the
consequences of failure to abide by the terms of a proposed agreement or to maintain satisfactory
repayments and should invite their consumer to seek impartial advice.
Members and their Intermediaries should not discourage their consumer from seeking impartial
advice or from “shopping around”.
No Member will employ, nor permit the use by any supporting or subordinate Intermediary, any
high pressure selling techniques or selling techniques unacceptable.

But i will ask one favour from everyone who uses this thread or see's it PLEASE PLEASE PLEASE if you see a newbie posting about PPI please point them in the direction of this thread as its only mutual help that will make us succeed and it will make it harder for sharks whom pray on young and lonely MSER's.

Hi Kaia it sounds like the old GISC regulations again and also adds another bow to the string that if you can prove that the person whom sold you the loan/policy wasn't trained or authorised then you can dispute the insurance. Think i posted the Consumer Credit Act paragraph previously but if anybody is in doubt its paragraphs 26 & 27 i think.0 -

Does anyone know of any case where it has actually gone to court? And lost? Received defence from Eversheds today who are the solicitors for LLoyds TSB. Today is the 28th day from the date of service as they acknowledged the claim.
Cant believe they left it til the last day! They sent the envelope by special delivery too, Arent I honoured!!PPI Reclaimed -

No not yet it will probably be on the PPI reclaim Success and Fail stories.
Misk don't worry about Bespoke being based in Gibraltar as:
1. It still an English Territory
2. There are provisions in the Credi consumer act for those guys whom operate internationally too.0 -

You determine how you wish the refund or rebate not them. As soon as they turn round and say they are rebating you they come under the durinctsion (spelling i know) of the laws of the country namely FSA and OFT so don't worry you do have the law on your side in this one. If you are really desperate let me know and i'll trawl out the necessary details.0 -
