    Yes hun I have heard of that happening before. You have waited long enough, so its time to move forward.;)

    Regarding the unfair rebate I am to pursue the lender for this, but the mis selling with the broker, as they arranged the loan and ppi from the start.

    If all with the same firm you need to add about the unfair rebate too hun.;)
    You can do this on the same letter and remember to add the calculations.

    hi sarah, if you are making a claim for mis selling then that will include the whole of the policy, including any rebate you didn't receive upon early redemption.

    I've frequently taken a clients claim to the ombudsman after the 8 weeks is up - and always send a copy to the bank - that really speeds them up

    The loan was over 25 years, with Endeavour, it was taken July 2004 and paid off in full in Nov 2005, it was sent to the FOS but they said they could not proceed with this because they were not regulated then, but that was about the mis selling and not the unfair rebate.;) (They only part rebate).

    M Colak did the calculations last week for me, but just to be sure I will not be wasting my time with Endeavour on the unfair rebate side of things then I will get moving with it.

    make your claim against Endeavour for the unfair rebate - as they were regulated in November 2005, if they don't unhold your complaint against them for an unfair rebate you can go straight to the ombudsman - mis selling and unfair rebates are different events and you can complain about them individually - just remember it happened in November 05 and has nothing to do with the mis selling in 04

    Tiggrae - thanks - thought i was gonna have to start the process again about the unfair rebate - mcolak did all the sums for me and drew my attention about the unfair rebate, i will drag his sums up for you to have a look at if that's ok - i did get a rebate but not much

    Brilliant, thanks again Tiggrae, so I must remember not to even mention about the mis selling on the complaint letter to Endeavour/and FOS if it goes that far, but just mention about the unfair rebate.;)

    Good luck hun, if I were you I would give them a timescale here too, say 14 days for instance.;)
    Considering they've had all that other time to deal with this, and personally I would also complain to the ICO too (information commissioners office), as they should really comply with the deadline dates.

    But yes, overall you have done the right thing here, if you want to make sure what Tiggrae or Marshallka or anyone else has to say I will leave that for you to decide.;)
