Yes this is confusing. From what you say Capital One is the broker and you should complain to them. Blemain is the lender and I would have expected them to deny responsibility and refer you to the broker capital one, but Blemain responded to the complaint as if they advised you. Which company advised you about the loan and PPI in first place?
hii singlep, this gets more confusing by the minute, i applied to capital one homeowner loans for the loan, i have copy of completed application form and i have NOT requested p.p.i, but the lender is blemain finance and it looks like they sold me p.p.i, as its on the loan agreement from them, however on the letter i got from blemain they mention phone-a-loan re the ppi. on looking through my paper work i find aletter fromcapital one saying they have passed my application to phone-a-loan who have th exact same address as blemain finance would they be part of the same company do youthink? confused yet?? so am i!!!! please help x x x

    Hi Supergrand.;)
This does not seem to be right, if they have added the ppi and you were not aware of it when you had taken out the loan its a defo mis-sale.
Have you all the contacts numbers for these firms hun ?
Reading into this, I agree its confusing and someone are to be responsible here, now this is normally the broker who sold this to you.

Even though the broker we had sorted out our loan, we did end up with the lenders paperwork, and they just told me to go back to the broker, because it was them who arranged the loan etc.;)

    Hope this gets sorted.;)

Aww bless you hun, loads of ((((hugs))) and BIG SMILES to you too.:D  .
Yes start with ringing Capital One ;) .

If you do this tomorrow, please post up and let me know what they say and I will get back to you as soon as I can tomorrow okay.
If you do not get any success with these I think maybe you could ring the FSA someone like them,or some governing body, because it could be you will be sort of pushed from pillar to post...... , you don't need this.

Good luck hun, I look forward to hearing from you.

  • Hi,
Im new to the reclaiming business, but I tried to reclaim from HFC earlier in the year and they said they did not agree with my request. The grounds for my claim was that HFC Phoned me to see if I wanted extra funds added to my existing loan. At the time I really needed some extra cash so was keen on the idea. During the Call I was given the impression that for me to get the new increased loan I had to take out the PPI. When I received the paperwork I only had one form that I could send back that had the PPI box pre-ticked by computer! In the past i was always sent two copies one with the PPI and one without, allowing me to choose. I feel that the way the last one came made it look even more like this PPI was needed for the loan.
In the letter they said that if i wanted to have the loan without the PPI i could have phoned and asked for a new quote without it, but at the time I was not aware I could do this.
Does anyone have any idea about this? do I have grounds to re-claim, and should I send it to the ombudsman? Many thanks

It was a fair while ago now, as I recall it was back in 2004. I will try and source the exact date.
Does when I took the loan make a big difference?
Many thanks for your quick reply

    Hi Simon.

I'm sure Tiggrae will get back sometime to advise you, but anyway the one of the reasons I know why it may be important date wise is because some loan firms were not regulated by the FSA until Jan 2005, this may be important if the case has to go to the Financial ombudsman service because if they were not regulated by anyone the FOS will be unable to help here, unless of course they were under GISC at the time.

Google in 'FSA REGISTER' this will allow you to put in the name of the company in which will confirm when they became regulated.

Still there are other ways this can be dealt with such as court but hopefully it will not go that far.

I had one the FOS are unable to deal with but are I am trying to exhaust many areas with these first, because the loan company I was with are linked to some groups that were regulated.

Tiggrae is amazing when it comes to this, so I expect she will be back sometime later to give you some advice.;)
