I am at the moment in two minds whether to challenge all three loans to see if I can find if they are void and unenforceable and see if I can go down this route.
    So for all those out there who are with Barclays beware. I have moved amyl all my accounts etc away from them now and my children accounts have been closed. As an aside with my bank account about a year ago I had a call from their fraud dept saying that somebody had been fraudulently using my account, they were very good at managing this but where it had taken w me over my limit I was charged over the next six days £180.00 I rang them up daily to explain the situation. Everytime I rang up I got nowhere and they would not take on board what I was saying but they tyxxx tried tosell me insurance everytime.
    I thought the best thing to do would be to go the local branch. The female in my local hailsham branch was beligerent and rude and tried to speak down to me (I am 50 years old, excuse me). Questioning other accounts and asking information which was nothing to do with her. She then tried to sell me insurance I could hve strangled her.
    Anyway thank you all for listening to my ramblings I feel better now:rotfl::mad:

    hi max - if you haven't got you money yet keep pestering the FOS, they'll keep on at Barclays.

    As for the women at the branch - make a formal complaint to Barclays, copying it into the local branch - these guys have got to learn they are not omnipitant and that they have to follow what is called TCF Treating Customers Fairly - if you think a bank member has been rude and asked inappropriate questions then complain - otherwise how do they learn that they can't just get away with it

    Wayne, Tiggrae has made a good point here, if they were all mis sold for the same reasons then only the one claim will do, sorry to confuse you hun, and this way Tiggrae said it will save too much work.;)

  • Hi all,

    I got a reply today basically telling me to go and take a running jump. Ignorned the fact i said they filled in the credit agreement form and instead saying i ticked the box (letter stated it was pre done by them)

    However they very kindly issued me with a colour copy of the loan application which has been completed by one of there members of staff in blue while everything i have filled in is in black (not alot) it also stated that the ppi box should be initialed by me and it isnt, it is ticked by them!

    So I have written the second letter and added in the extra information, just got to wait for the post office to open tomorrow then I can send it recorded.

    Their last reply was very quick (delivered monday to them) and reply received today so hopefully the next one will be just as quick!

    Will keep you upto date on how i get on.

    Thank you Tiggrae for the advice I will do so. I was so fed up with trying to sort something out and all they were trying to do was sell me insurance. The woman in Barclays could tell I was upset but was obviously more concerned over her commission.;)

    There also maybe a local number on their site to contact, I know I have one here which is Cardiff.
    They should give you some answers on the phone, maybe they have so many emails about the same sort of thing and just not getting round to posting back.
    Give these a ring, see what they have to say and good luck.;)

    I sent a recorded letter - do you think I should try phoning them? I think I'm gonna have to speak to them about HBOS aswell as been waiting 57 days now for SAR when they cashed my cheque over a month ago but just try to fob me off when I've phoned to chase things up.

    Yes I would try ringing them as a quicker method personally.

    Oh golly HBOS are way behind with the 40 day deadline !!:eek:

    Yes definately go to the ICO from here, there is a complaint form on the ICO site from what I can remember, even if they do still send the SAR now they still did not comply to the timescales of this.;)

    You can always mention about the HBOS the same time.

    well there are easy wins and those not so easy - for the first it'll be dependant upon whether they were regulated by the FSA at the time of selling - if they don't pay you can can complain to the Financial Ombudsman. If they weren't regulated you can take them to court - then it'll be dependant upon how resolved you are to get YOUR money back

    Also, on whether the policy covered you for unemployment - again this should have been brought up by the person who sold it to you and not by GE

    Yes this is confusing. From what you say Capital One is the broker and you should complain to them. Blemain is the lender and I would have expected them to deny responsibility and refer you to the broker capital one, but Blemain responded to the complaint as if they advised you. Which company advised you about the loan and PPI in first place?
