    I originally done the SAR with GE Money home lending, who then said it was loans.co.uk who brokered the loan, the SAR I got from GE only had a breakdown of payments and some screen grabs from what looked like an access database, also written down lists of telephone conversations, but no recordings for me to listen to, but the loans was taken out in June 2003. So it looks like its the FOS, as I get upto 2 years sick pay from work & also 2 years death in service pay, so PPI would not be suitable for my circumstances.

    Yes I see what you mean hun, I would get in touch with the ICO, the Information commissioners office, that loan company should have something on you, if within the limit time, and for them to say 'lump' if how the heck could they investigate ?

    They also have other information on the site which may help you, but I would give them a ring and see what these have to say.;)

    Going back to SAR's I am in fact waiting for a SAR from the brokers of e-loan who were the brokers to the lenders Nemo, I have already been supplied with the SAR information from Nemo where they state they only forwarded the SAR information from the loan advance apart from the agreement etc which they had a copy of, of the first loan when e-loan sold us the loan/ppi.
    The brokers should hopefully supply me with all the information from when they sold these products.
    If they cannot supply this information (e-loan) they should send back the payment I sent them with an explanation with this signed, it was a almost 3 weeks ago this was requested and they have not got back yet to say they are unable to supply it, so hopefully further documents will be forwarded.

    Do you know if your company were regulated by GISC then ? or FSA ?

    I'm thick so I need guidance. Are you saying that they have to prove where they got this phantom telephone information? Sounds far to reasonable for me.

    We are all here to also learn off others - me too.;)

    I just feel that if you contact the ICO they will be able to advise you of the best options here, the loan company may be fobbing you off hun, I would explain they are denying mis selling to you, yet they have invesitgated and say this was sold over the phone, but what have they really got to prove ?
    Only on a piece of paper maybe but if they knew this then they should supply you with all they have on you, also to prove this.

    See what the ICO say, meanwhile perhaps someone may be able to tell you the best option to taken, I am going to the ICO about a company breaching the contract, so hopefully they will resolve this, for you too.

    Hi Sparky hun.

    What I do know about SAR's is for every company you want information on, as you know you send the £10 payment, sometimes if you have a partner they may request if you want separate information you have to send £10 each, (some do and some don't), but say for instance you wanted a SAR from your bank, that £10 will cover absolutely everything they have on you.
    As far as I know it should be all the information on all accounts, I will try to check this out for you and get back as soon as.;)

    Sparky, just found out this regarding a SAR.;)
    Providing that the data subject (being the named person) is the one wanting this, but if you and partner want this then its 2 x £10. If they only want the £10 for both they must return the other payment of £10 to you.
    And yes this covers for all accounts for that account.;)

    I don't know if I have been clear,the arrears on the account are because of ill-health,therefore 1.had the PPi on the loan not been mis-sold I could have made a claim and would not be in arrears 2.had I not read Martin's Moneysaver reclaim section and followed the templates I would not now, having gone to the Financial Ombudsman Service, be in the position to have the mis-sold PPi's repaid.Therefore should M & S Money have taken the arrears outstanding from the personal loan out of their reluctant settlement figure?It took from 31st October 2007 to 15th July 2008 to receive the cheque.Am I being naive?:confused:
    did you go to the FOS and did they order M&S to pay up, if so go back to the adjudicator on your claim and say you want all the money paying back. When was the decision upheld ? Has a higher amount of interest been taken into account bearing in mind the length of time it's taken to get a payment?

    Hi folks.

    As you know Click have received the reclaim letter, as these are the brokers to the lenders of Endeavour, should I wait and see what the brokers say first or still continue to write to the lenders Endeavour about the rebate ?, because basically it was the brokers who mis sold this ppi but Endeavour who calculated this when settled.
    Not sure if I can try to pursue these the same time :confused: or not !
