    Hi
    I sent my letter off to Barclays on the 27th May they came back to me with a letter saying they are investigating my complaint and will get back to me no later than the 3rd June, the 3rd came and we received another letter say they are still looking into it and will get back to me no later than the 23rd July. I phoned them today to get an update and I was told that another letter has been sent out today (the 8 week letter) saying they are still looking into it!
    The girl I spoke to said that they have had a lot of people complaining about PPI so Barclays are now working from the oldest ones first so there is no telling when my one will be sorted.
    What shouldI do or do I have to wait until Barclays come back with a final response letter???

    there's no difference between making a reclaim for a loan sold over the internet as to a 'normal' loan. As for being self employed, if you pay category 2 NI you should check the policy details as you're probably covered, if not you'll almost definately won't be covered by the PPI and therefore, it's been mis sold

    take your complaint to the FOS - you can download a copy of the complaint form from their website. Put on that you've given them 8 weeks but they've failed to respond within the statutory - send a copy of the form to Barclays as 'a courtesy'

    does that mean that is what it worked out what they really did charged me sort of thing, comparing this to that amount of £208.51 on the agreement ?
    And was the calculation including the rebate of £1.553 odd that Endeavour deducted off when settled ?

    The £214.51 is the monthly payment it would have taken for you to have paid off the loan originally (in 300 payments) and getting the same settlement figure that you had received from them.

    Also if you received a rebate of £1533 have you confirmed what this was for? If it was for PPI then you were disproportionally rebated in the first place and therefore paid over the odds for settling the loan in the first place. At this point you have a choice take the £3722.68 and remove the £1533 and claim the difference as overpayment of PPI and then put a seperate claim in for the disproportionate rebate. Or claim the whole amount back if confirmed that the rebate had nothing to do with the PPI.

    Hi.

    Thanks again for getting back to me, regarding the rebate it just states they had deducted that amount of £1533 as part rebate, so I imagine this was for settling early but nothing actually explained.

    I have also came across some paperwork sent with the SAR 'underwriters' work about brokers commission where they were paid the amount of £1650, I did not know anything about this until reading about these issues on here and not sure who paid them, if it were the lenders or not because it does not actually confirm who.
    Can I also claim on that ?

    Had a reply from loans.co.uk, basically saying that during a telephone call I had with them, that they asked if I wanted PPI, and I said yes, so as far as they were concerned, they had not mis-sold me the PPI, and that this was their final decision, should I send my complaint to the FOS?

    I await any answers GE said exactly same on the wifes Debenhams card. I think we have to take the lying gits to court.
  • Never posted before,so please be gentle.
    I have received settlement cheque from M & S money today for £1449.49 rather than full amount of £2814.17. They have taken off the arrears totalling £1364.68 although they had agreed earlier this month to a reduced payment which was part of a debt management payment plan.Can I ask for the full amount because they did not say they would deduct this amount?
    I don't know if I have been clear,the arrears on the account are because of ill-health,therefore 1.had the PPi on the loan not been mis-sold I could have made a claim and would not be in arrears 2.had I not read Martin's Moneysaver reclaim section and followed the templates I would not now, having gone to the Financial Ombudsman Service, be in the position to have the mis-sold PPi's repaid.Therefore should M & S Money have taken the arrears outstanding from the personal loan out of their reluctant settlement figure?It took from 31st October 2007 to 15th July 2008 to receive the cheque.Am I being naive?:confused:

    Hi there Sparky.
    Can they prove this ?
    I would ask if you have not done already if they can provide you with a copy of the telephone recordings, if this was sold after 2005 and sold over the telephone then they should have the recordings.
    What about a SAR ?
    If you have not one of these, I would request this where they will as you know provide everything they have on you, phone calls too.
    This may make them think again.;)

    If this was your final response I would FOS them, if not ask them for the recordings.;)

    Not hijacking but your talking my language. GE have absolutely no record in my SAR re any telephone contact yet they have still told me to lump it. Hence I think court is thed only option.
