Thanks Anne-Jade.

Throughout the claim before we won, this case was with the FOS, so we did get in touch with these/nemo by leaving email messages, did keep the FOS aware of this, because when we did try ringing we would get told someone will get back to us but this never happened.

When receiving the SAR last month - something I wished I had requested a lot earlier, I could not believe the comments they left on these, such as 'hasn't anything been done about these people yet' we are still receiving emails !!!!! please get them stopped !!!!

But its a good idea to set up a new email addy, cheers hun.;)

Di, spent a bit of time today looking up defamation and libel and I think you should definitely get onto "them" about their comments as it's disgusting, how dare they treat you like that? You should go to the top and demand that the people that wrote those things are disciplined, if not fired and that you want a written apology at least. I think a court case for libel would be very costly and you would probably be throwing good money after bad.

I don't see any harm in sending the letter however I expect Nemo's
response will be that the case is now with the ombudsman and therefore
it will await the outcome of the investigation. I wrote to you yesterday
saying that Nemo had rejected my assessment of your complaint and
requested that the case be reviewed by an ombudsman. Prior to doing this
you have the opportunity to make an additional comments on my assessment
- a copy of which I sent you. I will await hearing from you further.

Yours sincerely

SO will post up when I receive it:mad:

Hunni, please do not worry, this just means they have not settled at this stage with the caseworker - which now will be passed on to the ombudsman themselves, I will tell you though it will take a little longer, but I'm sure it will work out in your favour.;)
Nemo gave them the same response with me hun, they are not easy and they will try to get out of it.
So any further information hun you can think of to send these, please send it now you have the chance.
Have you anything out of your SAR you feel that may help this hun ?
Did you notice anything out of the question when this was sold to you where this should be recorded and on the disc.

Any further concerns hun, please get back to me, I know how these work now, Nemo that is.;) ;) .

Was it motor finance?

Hi Laini :-)

I thought I read somewhere on here that the Ombudsman rarely goes against what the adjudicator says, so I'm sure you will be ok.

Don't like the sound of that Nemo - they never should have found him :rotfl:

Thx hunni, and I have a good mind to send all the copies with the bad comments on to the ICO, see what they have to also say, but first of all I thought I was being sensitive, then others had taken a look and said how disgusting it was, and the cheek of them passing the SAR information with all this added on them !

There was also a paragraph, a copy of mine they had of what the FOS had of ours sent from nemo, then all this info was sent back to them when it was completed and won, on the one paragraph I added that I was not prepared to give an answer on the loan advance yet, where at one time they kept ringing to pester about us taking the loan advance, I had told them as stated in the paragraph, "I have no time to discuss anything with them at that time, because my son who has special needs was home with me ill", hubby was at work and no one else available to look after my son, they wrote a petty comment on the side of it "SCHOOL" !!! It was something along those lines, then a comment made on one piece of paperwork says, the Evans's tried to cancel the PPI, I managed to talk them out of it !!!

But I'm not leaving it there ! (of course this was added after the FOS had them ) !

I recommend others if with Nemo to check their comments.;)

Thx hunni.

So its got to go back to the FOS again. Laini, i bet you are really annoyed with this. I wondered if anyone had ever had this happen. I do know that once it goes back and the ombudsman agrees again it is FINAL. How long have they given it til its finished? I really feel for you

I am surprised with the pre-occupation on this site with SAR on post Jan 2005 sales. Advise Central you are going to FOS. FOS will give you a tick box form and they will request the docs and call recording from Central. Tell FOS, Central did not make you aware of a "monthly premium alternative"which would have better met your Demands and Needs. These firms just want to get you into correspondence and frighten you. Just go to FOS as nearly all post Jan 05 single premium complaints are upheld.
I really couldn't agree more - the Financial Ombudsman has more power to request information from the business - don't bother with an SAR just take your claim to the FOS as soon as a complaint has not been upheld !!!!

In fact this forum should be split into pre-2005 mis selling and post 2005

lol, that's exactly what came to my mind, or maybe they are an associate who are linked to the financial firm involved who gets paid or the other way round to the broker ??..... , not certain but its not easy to search for really, have checked and its all enclopedia stuff, which does not really explain a lot really, then I'm not that academic lol.....:D
