Hi
Forgetting the issues I have and getting down to the basic question - Am I better off trying to claim the PPI or submitting a claim for it being miss sold? Assuming I cant do both or the latter when I am told its invalid.0 -

Please could I have your suggestions folks, thank you.:D
.
Okay now this loan/ppi is when the brokers of e-loan sold the loan to us and provided us with Nemo.
Will try not to confuse you but we had won the loan advance PPI a few months back with the FOS.
But now going to try to pursue the first loan of when we first had the loan which was sold by e-loan.
The first loan with e-loan was Nov 2005 so were regulated by the FSA, it was a joint loan but hubby was sold the single PPI for a secured loan of 25 years for 5 of those years.
Nothing was explained, only the fact that you get back so much percentage of this if you do not claim within the 5 years.
No other information was given, so we assumed it all part of the agreement itself.
So it was Nemo they found to provide us with a loan.
Anyway a few months on we requested for a loan advance with Nemo, as we were already with them we thought it was just as easy to do that, so they gave a quote, and for curiosity we requested for a quote without the PPI as we had just then learnt we could have a cheaper stand alone option elsewhere, they would not supply it, but were told even though its a new loan we would have to continue with the PPI or we would have to borrow more which we would not be eligible for anyway, so what choice did that give us ?
We had taken the advance in July 2006 but was angry with the fact of my hubby being pressurised into accepting the cover !
I looked into this further and thought right stuff it ! I'm going to request cancelling this but we missed the 30 day deadline to do this and hardly anything in rebate, (same here in rebate when closing down the first loan to start a new loan with these). But then only then was aware this could go further.
This case did drag on a bit but then I recieved some information including a disc etc which I played back during the advance sale - this proved it was mis sold and the FOS agreed which it went in our favour. We recieved over £12K for the mis sold loan ppi advance.
The FOS also added on his paperwork that even though we had the advance ppi upheld the first loan is separate to these where I can pursue on these separately.
But now to pursue on the first one, so here I need your suggestions if this is possible folks ?
I am in the middle of writing a draft letter to reclaim the PPI to the brokers (e-loan) who sold this from the start, because it should have been advised, the loan then was £41,000 they added almost £9K for the PPI on top.
We never knew anything about these products and how they worked and nothing was explained, we were not informed it was optional, my hubby has a life time back problem and did then years before taking this, but again nothing mentioned.
Do you think I should mention on the draft letter that we have already pursued and reclaimed from the loan advance that was dealt with by the FOS themselves ?
But as this is a separate policy we wish to reclaim here etc etc ?
Any suggestions will be a great help thank you.
(also just to say before we received the last mis sold payments we had paid Nemo off out of the way by remortgaging).
Thx again folks, you have been most helpful and am open to your suggestions/advice.;)

Hi Di
I may be barking up the wrong tree - but is e-loan e-loanshop.com? If so, I will expand but if not I won't add anything otherwise I will probably confuse.0 -
Okay regarding my above post, do you think I should email and request further information folks ?
I'm not saying they can do this though but think it may be worth a try.
As you know as I mentioned this before, Click Financial Ltd were linked to the HFC bank and Endeavour the HSBC group, but maybe I should ask the above who their Grantors were ?
What do you think folks ?
We were deprived of this mis sold PPI money and cannot reclaim this through Click, and before I continue with both HFC and HSBC, perhaps I could try to gather more info.
(these were not regulated until Jan 2005) where we missed out with this on pursuing through Endeavour).
I appreciate your feedback and advice, thanks so much to you all.;)

Hi there k80hav;)
Cheers for your feedback, I have come across the e-loan details, thanks......which is www.e-loan.co.uk probably under the same umbrella though I expect as e-loanshop.
Come to think of it, I have not really found any posts in this thread about this broker firm myself, unless I have missed this somewhere along the line.
Wonder if I will be the only one who is ever going to complain to these ?.
Does anyone know of any PPI complaints against e-loan ?
Cheers.

Go to FSA website, click on FSA Register, enter FSA no. 311877 and you will see they are still trading. It even gives you the details of the man to write to.
Hi there Singlep, and thanks hun.;)
I did have a look, and even though the information comes up, it was that who's name is shown (Ted Colegate), who had also contacted me to inform they that the first actual Click financial had dissolved in 2006, also confirmed by email to me by the liquidators, where these are now actually run as a brand new group but same name........, confusing though I think.....
I had come across this:

A big thanks to you anyway, this has been very helpful.;)The one and only "Dizzy Di"0 -
Even though I was told that Click financial dissolved in 2006, also by the liquidators (confirmed), it states some information that has interested me, such as the Insurance mediator, he looks like he is still with the company even though they are new but even back in 2005, yet not when we were sold the Loan/PPI.
Worth digging into though do ya think folks ?;)

If a FSA reg company goes into liquidation then compensation for complaints upheld at FOS is provided by the Financial Services Compensation Scheme. Some companies try to rise from the ashes following closure, these are called Phoenix companies and are illegal. Contact the FSA as something is wrong here.0

Surely they have some obligations.

Note in the legal bit something about Gibraltar.:mad:0 -
if you submit a claim for an illness which pre-dates your taking out the PPI policy it will simply not pay out - the insurance company will request a medical report from your Doctor which will confirm the pre-existing condition and they'll not pay all - all of which will probably take at least 3 months
  Ok so if I go ahead with the claim under the influence I am covered then get told its invalid due to a pre-existing condition  what would happen?
Can I then complain to the credit card company and make a re-claim and request compensation as well? What a headache!
I am not trying to make trouble or avoid paying my debts just seeing my best way foward as you can see now I am in a situation to make a PPI claim after paying out for the insurance each month (?) I am finding out its not valid anyway _pale_
Many thanks0
