    M colak, Firstplus were the people i actually had the loan with but apparently Freedom Finance were the brokers. (They say they were working for Bespoke Finance) so was the loan brokered by FIrstplus. I am soooo confused.:confused:

    Freedom finance have admitted in writing to selling it or should i say Bespoke have, Freedom where i sent the letter to then said that they would forward my complaint to a company called Bespoke Finance (formerly Karacus)

    I have written to the FOS about all of this as surely Firstplus have to be held responsible for allowing this to go on. Even they did not know an address for Bespoke and had to write to me. They should be held responsible for allowing these people to sell their products.

    Apart from the reclaim have you ever spoken to freedom finance or have you dealt exclusively with Firstplus. If you opened your loan with Firstplus and they filled in the paperwork for the PPI then they are the brokers. Freedom Finance were just an intermediary between Firstplus and Bespoke.

    An intermediary is a third party that offers intermediation services between two trading parties. The intermediary acts as a conduit for goods or services offered by a supplier to a consumer. Typically the intermediary offer some added value to the transaction that may not be possible by direct trading.

    In commerce, a broker is a party that mediates between a buyer and a seller. A broker who also acts as a seller or as a buyer becomes a principal party to the deal. Distinguish agent: one who acts on behalf of a principal.

    Loan - Firstplus (Broker/Loan agent)
    PPI - Firstplus (Broker) - Freedom Finance (Intermediary) - Bespoke Finance

    All I can say is I REALLY sympathise with you Marshallka, confusing isnt the word!
    Its a total shambles,I would wait to see if the SAR throws any more light on the matter.
    Could you perhaps get a free half hour with a solicitor to ask for guidance? or make an appointment at your local citizens advice just to clarify who you need to hold responsible.
    Once you know who is resposible, I would then personally fill in a claim form at the court.

    I have spoken to Freedom and they say that i saw an advert on teletext (never watched teletext) and then rang the number off there. They say that they then set the loan up for us with Firstplus and although it was freedom finance i rang they were actually an umbrella company of Bespoke Finance. When i spoke to Freedom they said that they would send my complaint to Bespoke and then i had a letter from Bespoke saying it was sold fairly and that was their final response in the matter

    In every case where people are successful claiming they are claiming against the broker. It is confusing which is why clarification is needed and the companies don't help but not accepting responsibility.

    Ok how did you take out the loan. By the way you have my sympathy's I agree with Kaia this is a mess (and surprise the companies aren't helping).

    Freedom Finance say from a teletext advert and that i rang a number. I really cannot wait for this SAR from them.

    The thing is someone is saying they are responsible and thats the untouchables in Gibrlatar, Bespoke Finance (formerly Karacus). This is a set up i think as i had never heard of these before then. If you look on Freedoms website it says

If these terms and conditions are not accepted in full, you do not have permission to access this Site and therefore should cease using the Site immediately.     If this has always been the case about Bespoke then surely they would not be offering payments out for ppi as my loan was before Kaia and Marluc. Would they not too have been directed to Bespoke.

    Also just googled Karacus and this came up and it was lowcostloans.co.uk. It says on their

    Please just tell me how you applied for the loan. Not what someone else has said. Phone/Internet/Office. If it was via phone who did you call?. If it was on a website which website?. If an office who's office?.

    When i google karacus it comes up as lowcostloans.co.uk and its again feedom finance

    It was lowcostloans.co.uk that actually sent a fax to land registry and if you look at the legal information for these its the same set up as Bespoke Finance. Did Bespoke Finance take over lowcostloans.co.uk as a sort of fiddle and then set up offices in Gibrlatar. I am beginning to think this is a matter for the courts alone.
