    there is no formula except very long winded calculations unfortunately. I have created something that saves me time and does it all for me now but unfortunately haven't finished it yet.

    i was declined mine back. :(

    they said that i was sold it lawfully and apparently it was explained to me when i signed the agreement :(

    You may have been sold it lawfully in the eyes of the FSA rules. Legally it could be that your agreement as a whole could be illegal - which the FSA/FOS have no powers over or ability to comment on.

    That is what most people are told at first. They are not going to give it to you just like that. If you read cases of the peeps that have won their claims you will see that they started off being told it was sold fairly and you were informed as this. You may be able to go the FOS about this if your letter actually states this is their "Final response" in actual words and depending who sold you the ppi and what dates. Don't give up yet.

    Surely if bespoke are the ones that offered the PPI, they would have to hold a consumer credit license to do this?

    If this is the case then they should be ruled under UK law and forced to abide by this. Clearly if they do not have a consumer credit licence or the relevant FSA authority to sell insurance products in this country then, it is indeed questionable.

    If it is looking like that they have set this up for the reasons we believe, I would go for the jugular of FF and look to get the whole loan made unenforceable or voidable.

    I cannot see how anybody can justify their actions on this...

    Hi Marshallka, let me know what you find out - I'm quite enraged about this, absolutely certain it's a smokescreen set up to avoid having to repay on mis selling - as to the County Court - you'de need to prove it was Freedom who sold the product to you - this should be easy enough through a SAR - but be aware if you do start proceedings against Freedom their solicitors will attempt to have the claim struck out as being nothing to do with them !!!

    the do have a UK consumer credit licence - that's not the point - it's the fact they are based in Gibraltar - taking them to court is no problem, but getting them to pay up after a Judgement is made is - UK bailiffs have no jurisdiction to seize goods in Gibralter !!!

    It is certainly confusing the way they work.....like Marshallka, we responded to the FirstPlus (Carol Bl**dy Vorderman) advert on the telly .....but it was Freedom Finance who set up the loan and PPI with the lender being GEMoney.
    Luckily for us , Bespoke were not involved, I really feel for Marshallka because this is far from straight forward and you can sense from her posts how upsetting and frustrating this is for her.
    I have sent you a pm Marshallka with the details of the guy from Channel 4 news who messaged me, if you want to contact him.
    Maybe bringing it to the medias attention will help you get it sorted.

    I sent him my telephone number and am expecting a call hopefuly this afternoon....how exciting !:rotfl:
