    Hi there one was September 2006 and the other August 2004 thanks for your help
    Claimed back almost £4000 so far from HSBC for mis-sold PPI
    £2083.00 + £242.00 8% interest from FirstPlus and lower monthly premiums:D Studio Cards paid off my account and gave me £125.00 in gift vouchers. £500.00 Barclays.

    The 1999 T and C state
    "permanent job" actively working in a paid job in the UK for at least 16 hours per week.....
    however in terms and conditions starting July 03 states
    "permanent job" actively working in a paid job in the UK. Your contract of employment does not have a given or suggested termination date and your employment does not depend on a contract continuing between your employer and anyone else. You pay class 1 national insurance contributions and your work is not temporary or casual.


    Seems they changed the conditions. did she pay Class 1 national ins conts?

    Do not have terms and conditions for 2006.

    My ppi claim has been with the ombudsman for a few months now. I thought i would do a bit of research in the meantime and found a really good bit of info which may help some of you guys. i have updated the info the ombudsman have as there is more miss selling i can prove now. According to welcome finance terms and conditions of insurance the insurance is only applicable if
    - you have been in full time permanent employment for 12months prior to the agreement with same employer
    - you have been in employment 24 months with same employer if contract worker
    - self employed and commision based employment is not covered
    - agency and temporary work does not get covered

    I fall into 2 of these categories (i have 2 jobs)giving me an extremely strong case now against welcome. The fact that i can prove with p60 and pay slips etc these points shows the insurance was worthless on my loan agreements. I am so confident now if i lose il show my butt in debenhams window lol. Its been a few months now should be getting answer any day......
    MY Successes = RBS PPI, RBS bank charges, Aqua PPI, Aqua cc charges, HFC PPI, Welcome Finance PPI, Blackhorse PPI Mums Ongoing= Swift Advances PPI, London Scottish PPI, Blackhorse chgs, GE money pyts missing

    Got a First Plus secured loan out with PPI in Nov 05, my claim for mis-selling is currently at FOS. Loan was for 50k so PPI was approx 12k making 62k, i have to date paid into this loan approx 18k, after contacting them re a redemption figure i still owe 60k :eek: I requested that the PPI be cancelled and got a figure from them that would be rebated to the loan - 1.5k :mad: surely this is not right ?? i have not cancelled the policy yet due to personal reasons but now i have just accepted an offer on my house so will need the redemption figure to be lower than 60k, how can i get them to give me more of a rebate or do i just wait until the house is sold, everything is paid then claim unfair rebate??

    I have phoned beneficial finance this morning to cancel the PPI
    They have come back and said I can cancel it but it would only save me 0.46p off my monthly payments??? because of this Pro Rata thing, they were coming out with all this jargon to try and conufuse me. Not sure what to do now, is it letter time????

    am not an expert on these situations but I do know that they will do ANything to get out of paying money back. This does not sound right to me. I think it is time to get serious with them write a letter as set out in Martins PPI templates will take a while but am sure will be worth it in the end. If you have to take it to Financial Ombudsman they are extremely helpful.

    May i suggest you contact the FOS and ask their advice on the best way to deal with it.

    Please, please can someone explain what happens when judgement by default is obtained? I too have obtained judgement by default, though no application to set it aside has yet been received. Thing is, as much as I have searched this site I cannot find info anywhere on what happens when a default judgement is granted - only that one can be awarded where a bank (in this case) fails to acknowledge or defend (the latter in my case). I'm sure there are many users obtaining judgement by default but it's abit of a black hole as to what happens next...

    How long should I wait for them to pay, allowing for reasonable time? What happens when they apply for the judgement to be set aside? If judgement has already been entered, why are they allowed to change it, especially if they didn't bother defending it in the first place? How long to I wait before obtaining a warrant? Have I actually won when I receive a judgement by default? Lots of questions I know... hoping for lots of answers... I know loads of people will appreciate it...

    I actually waited for their defence before I asked for the information. But I do not see why you can't ask for ot now. I would personally send a letter, recorded delivery. You know what ....:mad: .. they are.
    As a matter of interest, do you know which solicitors FF are using? I wonder if it is the same as the one for me? They are busy people...
    I had to pay my £300 into court yesterday. I am now getting everything together as it has to be at the court + solicitors by June 9th.
