Di should be writing to FSA anyway. I am not an expert on bankruptcy but I think the process is filing for, winding up and then dissolution. I am fairly sure that once they have filed they cease to be active for new business which looks like april 05.
We will have to concoct a letter tomorrow here then. We can't make accusations here but we can enquire.

Its looking brighter for her now would you say!!:D

And get on with the FSA letter tomorrow, and can it not be the same letter as what I'm sending to the OFT, or maybe a few other bits to be involved too ?
Cheers.

Simone Bespoke/Freedom letter here

I am in receipt to your letter dated 14.08.2008, received by myself on 06.10.2008.

I feel that your company misrepresented their position to me and are therefore in breach of the misrepresentation act 1967 as Freedom Finance acted as a broker when, in fact, you are now saying Freedom Finance was only the processor.

As the sale of the Payment Protection Insurance was commenced here in the UK and the processor acted as an advisor, therefore this was an unfair contract.

As a processor cannot be a broker and sell insurance. Freedom Finance are responsible for the sale of the Payment Protection Insurance as it was done here in the UK. Non advised sales of PPI did not start here in the UK until Jan 2005 and were introduced much later in Gibraltar.

Therefore, I feel that Freedom Finance are responsible for the sale of the Payment Protection Insurance.

As per the OFT register I have noted that Bespoke finance has listed that all correspondence is to be sent to Freedoms Finance address (as above). I will therefore be issuing any future correspondence, legal notices or documentation to the above address.

I will be contacting the OFT about your fitness to hold a Consumer credit licence as I feel that you intentionally misrepresented your interests in regards to the payment protection insurance aspect of my loan
I would add the FSA to the final para as it is good to tell them about the conduct of the directors as well. But really good letter.

Di, i would now change the date of CLick dissolving in the letter to "started to dissolve and posted in the London Gazette in April 2005 and finally dissolved in 2006. This then tallies with the dates of obtaining the new licence for CLick Financial Limited.

Done for you in the edited version i showed to singlep.

Advertised as dissolving in April 2005
Click Financial Limited got a CCL in January 2005
Actually dissolved in 2006

Planned or what???

I would allow another 24 hrs while we try to find out a little more.

Hi there Caroline.

There is no need to feel like an idiot hun these advisers tend to have a way to manage to suck us in, but at least now like us all here you are doing something about it.;)
You have learnt like we have and we have all been there.

Its get them back time !!!:D

So yes still reclaim, its your money - now go and get it back ;) .

Marshallka has given you some very good advice here hunni, go for it.

Good luck, and please keep us posted and don't let any stupid response you may get from them put you off, it may be a battle, but keep at it and you will eventually get there and get stronger on this.;)
