Is there a car that has wheels that are too big to be clamped?
BC - I sincerely, and publicly, apologise for, with what seemed to me to be a harmless and light-hearted post in what also seemed to be a light-hearted thread, having touched a nerve.
It was, never, my intention to start a 'Soap Box' style argument and I hang my head in shame.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

It doesn't matter Criminal damage is criminal damage whether the clamp belongs to a bailiff or tax evasion....
A person who without lawful excuse destroys or damages any property belonging to another intending to destroy or damage any such property or being reckless whether any such property would be destroyed or damaged shall be guilty of an offence
Meaning of 'without lawful excuse'
Section 5 of the Act gives examples of actions that would constitute a lawful excuse and thus a defence to criminal damage charges (though not to aggravated criminal damage under Section 1(2)). You must be aware of these, particularly in relation to the defences likely to be raised by motorists damaging wheel clamps.
A motorist who damages a wheel clamp to free his car, having parked on another's property knowing of the risk of being clamped, does not have a lawful excuse under the Act: see Lloyd v DPP [1992] 1 All ER 982.
This also includes bailiffs clamping vehicles.
I'd be interested to know which part of your previous comments you would class as "lawful excuse" criminal damage is criminal damage whatever way you look at it and whoever the owner of the clamp.
Instead of inciting people to commit offences why not suggest if they are having hassle from bailiffs clamping cars to call teh police to "prevent a breach of the peace." something that the police are willing to do and without the risk of getting scuffed at the end of it.

There is NO EXCUSE whatsoever to be suggesting people commit criminal damage whatever your crusade. no mountain whatsoever, there are people that WOULD follow your guidance and end up in a lot of trouble. You need to be much more cautious of that when posting as you do.
You can't argue with the law. If by making a mountain out of a molehill means stopping others that are having bailiff trouble believing that you are right in what you say then this mountian was definately worth making. end of.debt @05/11/11 £12210.63!! slowly chipping away!!:heart2:impossible is nothing.:heart2:0 -

It may well be an 'old piece of advice', BC - nevertheless it is correct.
Another very old saying is that 'Two wrongs do not make a Right'.

What you are saying is correct. In the sense of calling the police if there is going to be a breach of the peace. At the moment the police find out that a bailiff is involved they do not want to know and class it as private or civil. even though the bailiff has broken your arm and has also put your front door in.
