I'd just like to say I hope pandjscorpio is on holiday or something and has no thad chance to read/respond to messages posted since their post a while back. Having asked for our views, s/he has been PM'd and asked to get in touch, but no response so far. I'd like to ask him/her to at least comment in the forum on the responses to his/her post. Some of us have shared complaint and decision information and continue to do so and it is proving useful to others. Please join in, pandjscorpio. Looking forward to hearing from you soon, I hope.0

OK everyone. I'm out of here - last post for a while.
Those aware of of reasons why are also aware of current issues re RBS and FOS complaints and can pursue among themselves.

I just happened on this thread today - first time I have seen it since I originally commented (on page one or two) back in 2008. At the time I complained to the Bank but left it there. I intend to pick this up next week - georgeone - please don't vanish I need some help (I have none of my correspondence with them from 1999 through to 2008).
On a seperate note - when did they stop being 24 hours? I just rang them this evening to find all lines were closed - this may have happened years ago - but one of their (many) USPs when I signed up was the 24 hour telephone banking...
(on the bright side it is that issue that brought me back here to rediscover this thread - albeit one hour after gerogeone says he is off!)0 -

Hi everyone
This is my first public post. I'd like to thank Georgeone profusely for his help (via PM a couple of months ago). Like most people on this thread I am an early veteran of Virgin One and remember the promise / guarantee / early marketing that mislead so many of us.
Having watched this thread on and off over the last year, whilst the BoE rate plummeted, I have felt a mixture of admiration for the tenacity of everyone who doggedly wouldn't let RBS wriggle off the hook and disappointment that I'd shredded all of the early communications from Virgin One following an earlier house move. However, encouraged by the progress made by Georgeone and others, as they have selflessly shared on this site, I finally took the plunge in the summer and made a formal complaint to RBS. Having reached the "final letter" stage, I complained to the FOS and my case has just been allocated to an adjudicator.
So, although my journey is not yet complete, without Georgeone's and others' help and willingness to share their experience, I would not even be in the situation where my complaint could potentially be resolved in my favour. I should therefore like, belatedly, to offer my public vote of thanks for all of your help.
The FOS letter I received today stated that the FOS was currently "considering a number of similar cases. Whilst there are likely to be similarities between cases, we do consider each case on its own merits."0 -

Just an update in a way. It seems that Georgeone received a "Judgment" against RBS and RBS then had to comply with that "Judgment". What I and other seems to have received is a "settlement offer". Now at first this seemed totally logical to me as with so many similar cases and one judgment already made there was no need for FOS/RBS to go through every case to judgment stage.
In fact the letter from the FOS does lead you in this direction by asking if you want to reject the "settlement" then you should give reasons for rejection.
The settlement and the Judgment are different so consider carefully as it will depend on your circumstances which is best for you. For me the settlement worked and was better than I expected....but that was before the changes to the T and C's...
I have already accepted so no going back for me , but those still in the process consider carefully...0 -

Thank you for that post - it makes a lot more sense regarding the seemingly different solutions that appear to be around. Personally, I would hold out for the 'judgement' resolution.
One issue that has come to light is whether increasing your facility level subsequent to the 'promises' in effect resets the account. The adjudicator is still determining this.
I would argue that if it continues to walk like a duck and quack like a duck, then it's still a duck.
p.s. You coudn't lend me £61 billion could you? But don't tell anyone!0
