    I thought that this was one of those items that is delivered direct from the manufacturer (hence the no pick up, and wait 21 days thing). If so, then Argos / Homebase probably wouldn't have any stock information and will accept orders as they come through.

    As mentioned earlier I never expected to get the TV for 49p.... but I certainly do not agree with internet companies (or any companies) taking money for goods they offer but cannot provide. In this case it is about £5 but say it was £50.... 1000's of orders... £10,000's of pounds sat in their own bank account for a week or 2.... and more importantly some people would be without that money which they could use for better things (like bargains that exist) in the meantime. I'm not just talking misprices.... but any prices. If you can't deliver then don't take the money. If the law doesn't state this then I believe it should.

    I have just checked my credit card online and I have definitely been charged.

    I'm sure as an IT person Argos need/should have had somthing in place to stop the orders once stock was exhausted.

    Argos should have had some sort of real-time flood control to realise there were too many orders coming in for one particular product. They also should have very clear T&Cs on there web-site, and they should have some sort of validation on the actual prices before they are published.
    Does this need sorted in a court of law, yes. Would this make a 'good' case. Not IMO.
  • Dave, i agree wholeheartedly. It saddens me that people think they are owed something.
    Yes i did put an order in, it was worth the gamble. But what started out sat morning as a bit of fun has turned into this depressing argument about what we can get.
    At the same time though, i do feel a precedent should be set for online retailers as to when a contract is actually binding.
    I'm not thinking about this particular situation. (Let's face it, noone trully believed they meant to sell the tv's at that price)
    But thinking about the B&Q situation, and orders that were place, money taken, and genuine belief the orders would be fulfilled. B&Q can get away with giving nothing more than refunds because online retailings start of contract is unclear. The law has to change here, or online retailers will always be able to do what they like.

  • Going slightly off topic this taking money before accepting your offer to purchase, just imagine how well this would go down in the high street, you ask for your item,full price or whatever, pay for it then are told they will not let you have it and by the way we'll give you your money back in a couple of days!

    They don't where I work. Procedures may be rewritten, and then promptly ignored, cos people are in too much of a hurry to get things done. I can imagine the meeting they must have had, passing the buck all over the place.

    Trying to get motivated to send a couple of job applications away. By doing this I can put the other task off. I hate doing Application forms, on-line ones are ok (cut and paste), written ones....

    still no phone call,,,,,,still no e-mail cancelling,,,,,,,,, how much longer is it going to take them to sort out this mess. surely by now somebody must have been told NO.... you are not getting tv.
