leaving aside differences between scottish and english property buying systems i think its unfair to slag off all ea's . i don't think that people realise that when they bid for a house the agent is working for the seller not the buyer. buying property is a complicated affair and takes a lot of arranging. how many sellers are convinced that their house is the finest in the land and refuse to take reasonable advice on price ,
how many buyers say they have their finance arranged when they've not even spoken to the bank or put in offers on a property before their own place is even on the market. throw in gazumping and gazundering and at least two sets of solicitors lagging behind with paperwork , buyers / sellers not paying fees or filling forms in on time and every party with their own agenda its a miracle that houses ever get sold at all. like all professions there are some good some bad and some down right crooks.0 -

1. They called me last week and asked me If I was interested in the property going to a closing date. I said I was and they said not to put in my final bid now as they would be back in touch.....they didnt.
2. Registering a note of interest in the property does exactly this. Also calling them every week or so I assume lets them know I'm still interested.
3. That is irrelevant as they told me they would be back in touch for me to put in my final offer.
4. I don't know they told me a few days ago they would be back in touch with the closing date.

I didn't think a note of interest meant that you have to be informed of other bids - just a closing date if there was one. When I sold my flat I had two notes of interest but chose to go with the person who actually put in an offer and wasn't humming and hawing about it. I didn't want to go to a closing date, so the person was told that an offer had been accepted - as far as I remember he wasn't told about the bid beforehand. Sounds to me like you were told that there was a closing date, so you should maybe have upped your offer then?
I was told by my solicitor that you have to be informed of any further bids.
The EA told me there would be a closing date and they would be back in touch with the date and for my final bid, they didn't get back in touch.0 -

Yes under scottish property law you should have been told there was another offer and given the chance to offer too. End of story. Thats why up here you put in your note of interest through a SOLICITOR. It is a LEGAL step in the property buying process, not just a namby pampy 'yeah i like it'. Scotland is a whole different ball game.
Its 3 large double bedrooms, offers over 215k which is a complete steal given the area and the size of it. We could probably get around 270k for it if we werent in a hurry, but we are so...... we're flexible0 -

Okay I get it now, and that is out of order. If it didn't go to a closing date in the end, you should still have been informed. Have you phoned them to ask why they didn't get in touch?0 -

I think from what you have said the estate agent is to blame, hopefully the sale will fall through and they will come back to you.
But would you put another offer in anyway after the estate agent as treated you like this?
there should be a list on here of dodgy estate agents to warn other people from using them.
